SO I have been a green card holder for 3 yrs, married with my US citizen man for 4 yrs and is now ready to file for n400.

My big question is, can I petition a relative (my mom, using I-130) who is ALREADY here in the US, same time I file for n400? She got to the US years ago thru work visa but she overstayed. Will I have problems with this? I am her only hope.

Anyone who had the same situation? Did you get approved? Will that 'endanger' my US citizenship filing?

Aug 16 06 - Mailed AOS by Fedex 2Day

Aug 25 06 - NOA for AOS & EAD

Aug 30 06 - Received mail for Biometrics Appointment

Sept 6 06 - AOS Transferred to CSC

Sept 9 06 - Biometrics Appointment

Nov 03 06 - EAD APPROVED!!!! WOOOOOOOOOOT!

Nov 20 06- AOS APPROVED!!!! OMG THANK YOU! THANK YOU THANK YOU! ..now just waitin for d card to arrive ^_^

Get your USC first!

You have to be a US Citizen first. Then you can apply for your Mom.

as stated you have to be a USC first. The minute you get yu certificate you can apply for the I-130 not a minute before

Once you are a citizen your mom will be an immediate relative and overstay should be forgiven. As long as your mom entered the coutry legally.

A LPR cannot petition for a parent.

You need to be naturalized first.

I'm in a similar situation and I'm wandering if it is really true that "the overstay would be forgiven" for a parent when a child applys for her/his GC?

My mom is currently in US on tourist visa. Her I-94 expires in Feb 2010. I'm currently applying for US citizenship and I think it should take 6-12 month for me to get it. Should my mom go back to her country in Feb 2010 and wait until I get the citizenship? Or it is ok for her to overstay here in US?

She entered US legally and never violated any thing, but she already stayed for long periods of time (always legaly), so I'm not sure if they will let her back in until she gets her GC(which can take another 1-2 years).

I would really prefer her to stay in US, if her overstay will not hurt her to get GC once I can apply for it.

Would love to heard people with similar experience.

i am a us citizen to how can apply for my mother?? my dad holds a green card and he applied for her already and her gc has not come yet i don'nt know the deal but they i think denied it because we applied and her doc was sent to a wrong adress and we did not respond to it for a while because we did not know they sent it ,, any ways can i apply for my mom she entered in usa legally ,, but i thought it will be faster since i am a citizen and what form do i need??? should i wait till my husband gets here too??

08/14/09. - Nvc assigned case #( after 12 long days)

08/22/09 - Aos showed" paid "

08/22/09- IV bill generated ( and paid)

08/23/09- Ds 3032 accepted

08/25/09- Aos overnight

08/28/09- 864 got to nvc

10/01/09- hubby sent ds230

10/06/09- Rfe(grrrrr)

10/19/09 - LOG IN FAIL, FAIL,FAIL,FAIL,FAIL ( i did not even know what was going on !!!!!) MY BODY JUST FROZE IN FRONT OF THEPC !!!!

10/20/09- It is "official " per op "case complete" OMG !!!!

11/02/09- INTERVIEW date assigned , email received from nvc (Thankyou ! thankyou ! thankyou ! god!!!!!!! thankyou every one

in vj) (total of 35 working days in nvc)

11/04/09- package left nvc

11/16/09- Medical done and waiting for result

12/10/09- VISA APPROVED (slip given appointment for tuesday to pick up passport )

12/15/09- VISA ON HAND ( praise god )

02/01/10 - POE

03/02/10- Green card arrived
