Hello there, My name is Ross and I'm 20 and I'm in love with a girl called Kim who's 19, we met online...which is pretty unusual but we've grown to love eachother. We met eachother online through facebook around 6 months ago. One slight problem though, I live in England and she lives in North Carolina, America.

We plan to meet eachother at Easter next year and I would just like to ask a few questions and gets some basic answers so we both know what we will have to deal with in the future if all goes well. Being engaged and married is definitely an option.

I've looked around on the internet for some information but there's alot of information and it's very confusing so I would like some help please

1. What would be the most convenient way for me to be able to live with her in America and be able to work?

2. Is the K1 Visa the fastest way for me to be able to live with her in America or is the green card faster?

3. If we were to do the K1 Visa, how long would the process actually take? from submitting the form to receiving the actual Visa so I can live with her in America, an estimation would be great.

4. I understand that the K1 Visa does not allow me to work when I arrive in America and marry her within 90 days. I would need to apply for something else to obtain a social security number and a work permit, is this correct? if so how long would that take to get.

5. I've read somewhere that if we were to marry outside the US (In the UK), and I apply for a greencard, would that be faster/easier or is the K1 the ideal path for us to be together in America and for me to be able to work there.

Sorry if I don't make alot of sense, this is all very new to me and I would like some help please, I've read through a few guides but I would like some answers from people who have experience in this.

Thank you for reading & I appreciate all the help I can get!

1) Fastest is K-1 since you can apply right after you both meet. Fastest to work Cr-1. Neither is convenient. Both are expensive and time consuming

2)See #1

3) 6 - 8 months. Maybe longer, maybe less

4) approx. 90 days after you file AOS and for EAD and AP

5) See the guides for what visa is right for you.

1st thing is you two must meet, it is a requirement for the K-1. So take some time, read the guides and figure out what is best for you both.

Good luck.

This process is long and involved. You seem have a lot of time to read here and learn what are the options as you must meet first before your US finacee could submit a K1 fiance petition.

Be sure to get a handle on the costs involved with the different visa tracks.

Your fiancee/spouse would need to qualify as a sponsor for the Affidavit of Support. If your fiancee/spouse does not meet the income requirements then she would need to secure a co-sponsor.

Read the Guides thoroughly as well as the UK regional forum. You will pick up a lot of knowledge and likely find other couples similar to yourselves so that you can follow their progress and any snags they may experience along the way.

Thank you for the quick response :).

So within 6-8 months of meeting eachother and applying for the K1 Visa I'll be able to live with her in America, then I would need to wait 90 days after applying for the correct forms to be able to work there legally, is that correct?

So applying for a green card then marrying her would be alot slower then right?

Is there anything else I would need to know?

Thanks for the help though!

you cannot apply for a greencard and then marry because you have to basis of eligibility for the greencard... the marriage must come first and then apply for an immigrant visa (which results in a greencard after US entry).

YMMV

Ah I see, thanks for clearing that up, so it looks like the K1 Visa would be ideal for our situation. Another question, I have no idea about the costs, could anyone tell me a rough estimate for the total amount this process would cost, if that's possible.

So I would need to start saving up now if I'm not able to work and earn money for 90 days of when I start to live in America I guess!

I applied for the K1 (fiance visa) and if I could go back in time, I would have marreid him, and then knowing what I know now, filed for a CR1.

If you read the guides, like multiple people suggested, you'd know about the fees. Or you can go to the USCIS website. If you're going to go through any of this you're going to have to learn how to read the guides and instructions.

Hi Ross!

It looks like you are very excited/impatient to be here with your lady love! Nik and I also stumbled on the K1 visa while we were investigating how to meet for the first time. For right now, just thinking about which path you might want to take in the future and looking into the requirements (similar for both) is what you want to work on -- Oh, and getting to know your girl better!

The spouse (CR-1) visa results in a green card upon entry (permission to work) and is the cheapest option at somewhere around $1000 (Not including air fare or other incidentals like marriage license fees). The process takes slightly longer, but you can visit while it's processing, and there's no period where you are not allowed to work (whether you can find a job is up to you!)

The fiance(e) (K1) visa results in a one time entry visa, and you then need to marry within 90 days and apply for adjustment of status (green card). The total cost (again, just for the process, not including incidentals/air fare) is closer to $1500+. This is the fastest process for permanent entry, but the most expensive, and involves extra steps before the green card is received.

You can check out AVERAGE times for these steps by clicking on the "Immigration Timelines" link at the top. Be warned, there is a huge spread in the data, the averages may not be at all applicable to you, so keep any plans flexible. There are many ways to intentionally delay the process, so file as soon as you know you're going to.

Also, as you come to visit this Easter, you might take a look at what sorts of things are recommended in order to show "proof of ties" to the UK, as you may find yourself being questioned a bit more closely when you say you are on your way to visit your girlfriend in the States. Also, be sure to take pictures and tuck away your boarding passes (NOT itinerary, the actual boarding cards themselves) in a safe place. You'll need both for later!

~All the best!!

Does your gf have a job where she earns at least $18,212 annually? If not, she will need to line up a co-sponsor for the Affidavit of Support.

Yep def close to $1500. actually closer to $2000.

Petition fee is $545. visa fee $131. medical $213 in Phillipines varies by country approx. $50 police certificates/nbi/cenomar $1010 AOS, so thats approx $1950. doesn't include airfare to and back from medicals and interview unless she lives close the embassy, doesn't include hotel costs for time doing medicals and interviews then on top of that the airfare.

Your K1 Visa will cost you about £1600 give or take. Sounds to me like you're jumping the gun a little though. Why not meet her in person at LEAST a few times before thinking about marriage. I know it's hard being apart from a girl you like/love (I'm in the same boat) but think.... would be still be marrying a girl you met 6 months ago if she lived down the road? Spend as much time face to face with her as physical/financially possible.
