USCIS at my door 6 am today

This is dangerous advice and 100% inappropriate. It is very difficult to avoid the use of vehement profanity in further description of it. The correct advice -- that in post #6 of this thread -- needs to be read and understood by everyone on VJ, copied into a stand-alone message, and pinned.

Hey, Champ, post # 6 is the one I am referring to, which reads: "I will cooperate in every way required by law. The law requires YOU to get a judge to sign a warrant, and then the law requires ME to let you into my home." This is not inappropriate advice.

Which one did you think I was referring to? Does any one post make more sense? Why overreact if you don't understand what is being said? Let cooler heads prevail. It will lower your blood pressure. Peace.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I didn't see any other advice that made sense.
The sense from reading the subject post, especially in light of the one before it, was "cooperate or end up handcuffed" -- "give them what they want or be abused at an out-of-control government agent's whim." Had the phrase "the other poster" been specified as post #6, my response would have been one of vehement agreement.

The above aside, post #6 is valuable, and I believe that it should be pinned.

Random comment. I'm guilty of nothing. So I would have let them in. I understand Post #6 is correct but I still wouldn't do it unless I felt I had something to hide and needed time to "cover up"... that's the whole point of a surprise inspection, no time to cover up.

So that said. Yeah, Post #6 is great advice that everyone should be aware of their rights.

p.s. i prolly would have told them to wait a sec while I got dressed, brushed my teeth and woke myself up a bit :P

I know a couple whom this same exact thing happened to. It was 6:50am. The husband was also overseas. The wife let them in. They went through everything. Had been together for many years. Clothes everywhere, photos everywhere, etc etc Tons of proof sent with the AOS application (which took almost 3 years for them to get to, because of security checks - MENA man). Even after all that they were sent an "intent to deny" letter and they sent MORE proof...and still in the end, he was denied and he was arrested and put in detention pending a hearing (which they later won). So be prepared for anything.

If I'm not mistaken, if they deny your husband's petition and he is out of the country, he cannot come back into the country to fight it. You can check with a lawyer, but I think that is true. I think the reason is that once they deny the AOS the immigrant is immediately out of status as of the moment that decision is made. So if he's out of the country already, that means he has not eligibility to come back in. They (she hired a lawyer on the spot) had to get her husband back ASAP before they got a final denial. So you might want to get your husband back home ASAP. Again, double check with an immigration attorney because I could be mistaken.

Yea ya gotta let'em in. I just hope if they come here that my undies and ....um...well you know ...are not laying 'round.

I'm pretty certain that DHS doesn't run under the same laws as regular law enforcement agencies. After our run-in with them concerning Hicham's family, we quickly found that they have limitless powers. So, I don't think they would need a search warrant.

Being aware of your rights is great. Possibly losing your AOS because you refused to let officers in for their suprise inspection...not so great. Yes, I know..they cant deny you because you refused them in without a warrant, but the sad fact is, ya..ya they can

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

They didn't have a warrant. If they did, they wouldn't have knocked.

You have rights. Whenever ANY government official comes to your door (especially at ridiculous times of day or night) and asks if they can enter, you should always ask for a warrant. If they don't have one, tell them to go get one, and then call a lawyer. Make sure the lawyer is at your house before they get the warrant. You are not required to allow government officials into your home unless they have a warrant.

Warning: There is a trick question that law enforcement officers like to ask when you tell them to go get a warrant. They often reply "Are you refusing to cooperate?". NEVER so "Yes". They can arrest you on the spot for refusing to cooperate. Just say "I will cooperate in every way required by law. The law requires YOU to get a judge to sign a warrant, and then the law requires ME to let you into my home."

Not good advice. Yes, you have your rights. But you have no right to getting the AOS. Sometimes it's best to lay down and play dead.
