im planning to go back home to marry my indonesian fiancee. we have been engaged for 2 years. i have been putting off applying cuz of my poverty level was low. im now barely above the financial requirements to sponsor my fiancee and her son. i was told submit at 2010 when my income tax will show that i will be $2000 over the requirement. will they reject me if i apply now and my current income is only $400 above the requirements ? or should i wait ? if i do rreturn to indonesia, can i still submit the i-130 at the embassy or i must get married and submit it back in the states ? and how long is the process if i do submit back in the states ? and will they be suspiscous if i were to do this ? thank you...please give me some advice. dont know what to do ??

It would be better if you had a co - sponsor. But, if you meet the 5 times above the poverty requirement, then you "should be" good to go. The requirement is there for a reason, They cannot decide you need to meet some guideline they make up in their heads.

Went for her interview on July 16th and received her Pink Slip......Finally. Paid the AIR21 and I expect her here August 10th, 2009. Marriage will be August 21st, exactly 4 years to the day that we first met.

Going home to marry your fiance? Are you a USC? You can only file at the overseas embassy if you are a legal resident of that country for more than 6 months, otherwise you will file the papers in the US. They won't be suspicious if you marry abroad and return to the US. Many couples do that.

Going home won't change the amount you need to sponsor her. Can you find a second job that will bring in the extra money or get a co sponsor ? if you are only 1600 short you only need to show just over 100 more a month.

This will not be over quickly. You will not enjoy this.

thank you for the replies everyone. my 2008 income tax showed i made $19,400. And it stated that i need somewhere in the $18,000 ish to be able to sponsor my fiancee and her son. My 2009 income should be at $22,111. and i would have about $3000 of saving in my bank. Should the 2008 w2 income sufficient or should i wait for my 09 w2 to come through first ? And btw yes i am a us Citizen through naturalization. I will be going home to get married back there. and i will return to the states so i can bring both my wife and step son. and one more question please. with the i-130 should i inlclude i-864a or i-134 to show my ability to support both persons ? thank you guys.

If you're going to marry in Indonesia, then you need to follow the CR1 visa path. You won't submit an affidavit of support until after the petition is approved. When you do, it will be the I-864ez or the I-864.

The appropriate poverty guidelines are pasted below. See the one for three persons.

POVERTY GUIDELINE for the 48 Contiguous States and DC:

1 Persons in family: 10,830 (125%: $13,538)

2 Persons in family: 14,570 (125%: $18,213)

3 Persons in family: 18,310 (125%: $22,888)

4 Persons in family: 22,050 (125%: $27,563)

5 Persons in family: 25,790 (125%: $32,238)

6 Persons in family: 29,530 (125%: $36,913)

7 Persons in family: 33,270 (125%: $41,588)

8 Persons in family: 37,010 (125%: $46,263)

22K? Bro, I know your in love but 22K? Regardless of the relationship. Trying to support 3 people on 22K a year is not a great idea. I do not want to sound like money is everything, its not, but your income level is not going to provide the kind of stability she and her child will need here. I am not even sure how you can travel there and back with your wife and her child.

You are taking a serious risk here and I base that on my own frugal life experiences. I am very conservative with my money and it is not easy. Unless there is some other factors I do not know about, I would venture to guess that my fellow VJers may agree with me. Think this one through. Good Luck to you.

CR1 visa..where can i obtain this form ? and maybe an example form for the cr1 visa ? so i didnt know i would fall under 3 persons family category. must really sound stupid. i thought it would be just my fiancee n her son. Im hoping with the 3000$ saved and an additional saving would help me qualify for 3 persons. I am thingking of getting co- sponsor from my parents who resides in indonesia but a US resident. when i was still a green card holder my parents made me buy a property in indonesia and it is under their names. it is currently worth about $60,000. i might have to sell the property to boost up my saving ? will this be allowed for me to have an additional income or saving that is not based in the US ?? thank you guys....yes please..where can i obtain the cr1 visa if this is the form that i must petition instead ? and would this be a faster process than i-129f instead ?

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg
