Hi Everyone!

To start of, our upcoming wedding will be on next Saturday. We wanted to file for my AOS a week after our wedding. At this moment, I am home and almost done with our wedding preparation so I am preparing documents and assembling the package for my AOS filing.

I need your help guys to check if I am missing something in the package that I am trying to assemble. Please give suggestion or share any ideas about the documents that I need to prepare. I really appreciate any response.

Here is what I am trying to prepare for the package:

you're good to go! hope your i-693 (from gen. surgeon) is in a sealed envelope.

make one last check of every entry in every form you're submitting, make sure everything is signed and every question properly answered.

In the AOS interview for my wife (immigrant that is adjusting) they asked for 2 passport photos of the spouse (me) in addition to the 6 passport photos of the person adjusting (wife). Also, they asked for a copy of my birth certificate and the wife's birth certificate.

I wonder if they ask for my fiance's birth certificate coz when we applied for marriage license, the court house checked his birth certificate. Well, anyway, I will include the copy of his birth certificate.

The initial package should include just what was asked ? I might be wrong...

I agree with you, the original package should not include the proof of bonafide marriage; you bring that to the interview. I don't think its going to harm in any way the petition, but they're simply not going look at ir and you're going to have all those documents to the interview anyways, that is, if you have one. Did you get the G-325A for your husband? I didn't see it on your list. Also, definitely include a copy or your birth certificate and his. If yours is in a different language get it translated too.

This is what I did for my COVER LETTER-- although our civil ceremony is Monday, it doesn't hurt to get an early start:

Nature of the submission: I-485 Application to Register Permanent Residence or Adjust Status

To Whom It May Concern:

Enclosed please find my Form I-485, Fee of $930 + Biometrics Fee $80, I-693 Form, I-693A, I-864, I-765, and I-131, application to register for permanent residence adjust status after entry on K1 Visa.

Contents include:

- Copy of Hwang’s U.S. Entry Passport, first page (bio) + U.S. Entry Stamp Page.

- Copy of Hwang’s K1 Visa page from passport

- Copy of Hwang’s I94 (Front & Back)

- Copy of K1 Visa Approval Notice of Action from USCIS for petition I129.

- Copy of Birth Certificate-(Hwang) with English Translation

- Copy of Marriage Certificate

There is nothing wrong with sending some of the evidence that is presented at the interview along with the initial package. This is referred to as Front Loading and is advisable at both the visa stage as well as the AOS stage. (Search for posts from Ellis Island in the Asia:East forum. The poster is an US immigration atty with a lot of experience in a higher fraud (Vietnam) consulate)

In both cases the CO or IO will review your file prior to the interview and prepare their questions and determine if they have any concerns. By giving the IO more information to base an opinion on prior to your actual interview that ought to make for a more successful outcome. By no means a guarantee, but solid advice.

As another veteran VJ'er points out repeatedly, this process is not about meeting the minimums. Rather it is about preparing the best case you can for whatever you are pursuing (visa, AOS, ROC, naturalization) and obtaining the desired result without RFE's and delays.

Yes I agree that the more the better, and like I said, sending supporting ducuments is not going to hurt the petition in any way. I did too consult with several immigration attourneys and for some reason they told me that I shouldn't send that information with the original package. Maybe my case was different because I didn't enter with a spousal or fiance visa, so I was going to requiere and interview anyways. I really don't know but thats what they told me so i'm just telling you my experience. But IMO really focus on the requirements of the application itself more than the proof of bonafide marriage, and make sure all the forms and the supporting documents of the forms are included. Always double check everything.

Well for my case, I didn't come with a fiace visa, the USC had to include a G-325A too. I am almost positive that you have to too, but please someone that came with a K-1 correct me if i'm wrong. But if all AOS are the same, you have to definitely include the G-325A for your husband =)

Only person who needs a G-325a is the foreign Husband/Wife. It is not the USC's petition. All the USC needs to provide is financial information.

Good morning UK friends. Somebody recently asked me for my list of what I sent for AOS. This is modified from my cover letter and may help some of you get the big picture of what to start preparing. This is for K1s.

I-485 (Adjustment of Status)

Photographs (2) of immigrant (passport type)

Photocopy of birth certificate of immigrant with translaton

Photocopy of passport biographical page and K1 visa page

Form G-325A Biographic Information Sheet (immigrant)

Form I-864 Affidavit of Support (by USC) with photocopies of supporting documents: This varies by each applicant so here's generic suggestions

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

(If needed)Form I-864 Affidavit of Support (by Co-sponsor) with photocopies of supporting documents:

---Proof of co-sponsors citizenship/status, ie US birth ceritificate, bio page of passport, naturalization papers, or LPR status

---Employment letter

---3 tax returns including copies of W2s (Photocopy)

---six recent pay stubs (Photocopy)

Photocopy of I-797 Notice of Action, I-129 Petition Approval Notice from USCIS (That's your NOA2)

Certified copy of Marriage Certificate

Photocopy of Form I-94 Arrival/Departure record (card from the plane, may be stapled in passport)

Form I-693 with the immunization section filled out by a US Civil Surgeon, signed and sealed by him. Read the instructions for the form.

or DS-3025 from UK medical if all shots were completed at Knightsbridge if you want to take that chance

I-765 (Employment Authorization)

Photographs (2) of immigrant (passport type)

Photocopy of passport biographical page and K1 visa page

Photocopy of Form I-94 Arrival/Departure record

I-131 (Advance Parole travel document)

Photographs (2) of immigrant (passport type)

Statement of circumstances that warrant issuance of advance parole

And a check for $1010 made out to the Department of Homeland Security

That's 3 separate applications with supporting evidence all mailed together in one envelope with one check. They will get processed in different places, so that's why the duplication of evidence. You don't have to do all three, but the second two are free if sent with the AOS and will get you authorized to work or travel sooner than waiting for the green card to arrive in most cases. Green card could take 6 months. Work and travel 60-90 days.

Do not work until the I-765 is approved and you have the EAD card

Do not leave the US until the I-131 is approved (K1s) and you get the travel documents or you will not be allowed back in. Once you have a green card, then no problem.

Assembling the I-130 Package: Checklist

Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.): 1. Payment as required by USCIS. Use a money order so you can track the payment. If a personal check is allowed, use that instead.

2. Cover Letter. Should include a description of what your are petitioning for (I-130), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

3. Form I-130: Petition for Alien Relative

4. Copy of the Full Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.

5. A copy of petitioner's proof of naturalization. (If applicable)

6. A copy of petitioner's proof of permanent residency. (If applicable)

7. A copy of the intending immigrant's birth certificate and/or passport along with English translation. (If in any language other than English)

8. A certified copy of your certified marriage certificate (again, translated if not in Engligh)

9. A certified official copy of the petitioner's and/or intending immigrant's divorce documents. (If one or both of you have been divorced before)

10. A copy of a prior spouse's death certificate. (If filing for a spouse, and one or both have you were married before, and the prior spouse died)

11. G-325A (all four pages) filled out by the US Citizen signed and dated

12. One passport-type photo (see specification) of the US Citizen. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

13. G-325A (all four pages) filled out by the foreign spouse signed and dated

14. One passport-type photo (see specification) of the foreign spouse. Write the full name of the beneficiary on the back. Place in a plastic bag and label the bag "Photo of (insert name) ". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

15. Evidence of a bonafide marriage (see note below for what to include)

Again, I had to filled the I-130 because I was already in the USA when I did AOS. Maybe this why.
