uscis's 60days limit is over ... what 2 do now ? please help ?

hi

i've filed marriage based I485 since nov 2008 .. everythin is done including ( finger prints, I864, I693, Bc Bona fied) last updated was in19 May 2009 when uscis recieved my I693 and resumed my case and said that i should expect a written decision within 60days now that limit is gone and my case is still pending :(

what should i do now ?

marriage based I485 usually approve way early than mine but mine is still pending from almost 8 months ...

can any one suggest what should i do now please ?

i'm so worried ...

If you are very concerned you can try calling the 1-800 number, listen to the options and select the one that says your processing is out of date, which should get you to an operator. You can ask the operator your question. Ideally he/she will move your call up to an immigration officer who will be able to answer your question. The person who answers the phone, however, is not an immigration person, just a call center person, and she may not pass your call on to immigration.

If calling doesn't get you the information you want, you can try making an infopass at your local USCIS office. Go to http://www.uscis.gov and on the right hand side chose "Schedule an appointment" then follow the directions. It will mean going in person to your local USCIS office on your appointment date and speaking to an immigration officer. It may or may not give you more information.

You may also choose to wait a little bit longer. Give it another month - sometimes AOS takes a while, especially when they have sent out an RFE. Good luck.

Make an infopass app and while you wait for the app keep calling them until you talk to someboby. Good luck

NOA I-485 April 1st 2009 - received

RFE - request initial evidence for I 864 April 13TH 2009

SENT evidence April 23rd 2009

BIOMETRICS DATE April 24th 2009 - Done

NOA I-485 JUNE 15th

INTERVIEW DATE JULY 30TH 2009 - APPROVED 10 year Green Card!!!!!

Don't worry to bad. I filed for an i-485 along with an i-130 in may of 2008. I still haev not heard anything and it is still pending. I have had my biometrics done, as well as the interview. I have file at least 15 different service requests, and get nowhere. I have also went for at LEAST 5 info pass appointments and nothing has happened. I am going through the Philly office. So I am in the same situation as you. just be patient.

AOS Process

May 29th 2008- AOS/EAD/I-130 Sent to Chicaogo Lock Box sent via Overnight Delivery

June 6th - Both checks cashed!!

June 25th - Biometrics appointment

Sept. 19th - Card Production Ordered! (113 days since filing)

Sept. 25th - EAD Received!!!

Dec. 5th 2008 - Received appointment letter

Feb. 4th 2009 - AOS Interview (Interviewer says going to recommend for approval)

May 15th- called and talked to an officer to submit a service request

June 10th- Made an infopass appointment,

June 15th- Info pass appointment, told me they could do nothing until the officer made their decision!

June 27 - Filed for I-131 as well as renewal of my work authorization.

July 23rd- Received I-131

Dec 22, 2009 - Biometrics appointment yet again.

January 21, 2010 Second interview

January 22nd - I-485 Touched

January 27th - Received a Request for additonal evidence.

May 27 I-485 Approved

June 13th 2010 - Green card received!

Just be patient, there is not much else you can do. Maybe touch base with your senator and make them aware of the situation. We filed for AOS October 2008 and for 9 months heard nothing, status was pending. Exactly 9 months after they received it they sent and RFE (we have not received it yet). We had sent several service requests for it being out of processing time and had three infopass appts.

I found it strange that for nine months nothing and then an RFE.

All you can do is wait and not drive yourself crazy trying to understand the system.
