RFE for removing conditions on I-751(CR189)

I received an RFE on 7/0/09 and have been asked to send the following by August 30.

1. Submit evidence that you and your spouse share a variety of joint assets and liabilities.

2. Submit the leases/mortgages for all of your residences since marraige.

3. Submit copies of W-2/1099 forms of you and your spouse for the tax years 2006, 2007, 2008.

4. Submit a sampling of photos taken of you, together with your spouse, throughout the course of your marriage.

For #1:

I can get the bank statements for our checking/savings account for 1 year. Prior to that we had separate accounts.

We don't have any other loans except for one credit card account which is in my name. My spouse has an additional card under the account.

We both work for the same employer and we got separate health insurance policies as it was cheaper.

I can send the auto insurance policy that lists her as insured.

I already sent life insurance policy statements that showed each other as beneficiaries.

For #2:

I have lived in a home that I bought with my father way before I got married. Hence I do not have my spouse on the mortgage. Neither is she on the home owners insurance. My parents live with me in the same house.

I don't have her on the utility bills either because the bills have always been in my name since the time I bought the home.

I have # 3 and 4 (all the pics are in digital format. fortunately some have dates on them. i plan to get the pics on paper with a description and send it in).

I am scrambling for ideas on what else to send. Any help will be appreciated. My wife is pregnant and is in her 7th month. Should I get a paternity test and send the report in to prove the marriage is genuine.

What did you send initially?

Your driver's license with the same address help. Do you have any say magazine subsciptions together?

Send in an explantion letter as far as the house as you are not the first in this corcumstance. Why was your SO not added to the account as far as utilities? It really blows, as for the last 2 years every time I buy or order something no matter hwat it was I did it in both names so as to satisy immigration.

Originally I sent two affidavits from my friends, copy of tax returns for 2007 and 2008, and letters from pension and 401K funds showing my spouse as my beneficiary. Thank you. I will add the driver's license to the list of things to send.

Some ideas...

What about Christmas greeting cards, baby showers, invitations etc

Some events, hotels booked together.

Some mail or emails sent to you both or when one has written email on behalf of somebody else.

I am pretty sure that you can ask your power bill or cable can be put on both of your names.

In most forms you fill for whatever reason there is question about how many people in the haushold and asks to name them, (at least that is in all students loans stuff.)

Get some subscription for magazine,

Get some shopping card, for example, Khols, with both names on.

Donate money to local fireman and both sign it.

Get checkbook with both names on.

Get affidavits from people around, who can verify that you are happily married couple.

P.S. And plus also send again the same thing that you sent in the first time.

It is possible they simply lost it and need it again, but will not admit it.

Auto insurance coverage pages & auto registrations showing you both as owners or showing the same address

Mail addressed to both of you

Copies of checks where each of you paid household bills (this is not very common)

Anything from her doctor visits that may list both of your names

Joint bank account statements are always good evidence.

write your wills listing each other as spouse and heirs/executors; even though you filed your taxes separately it should still list you as 'married, filing separately' so include those earlier taxes as well; you can purchase life insurance benefits or if you have them through work show your spouse as beneficiary; include a notarized statement from your parents regarding all of you living together in the same household; if she has paid any bills regarding the property or household that include her name and address include those showing she is accepting liability for the property as well. Do you have a family cell phone plan with both your names/numbers? AAA memberships with both your names? Costco/Sams membership with both your names? Good luck.

Put EVERYTHING you already submit at first hand plus put anything extra has joint or just seperate names on it..

-Joint bank acc statement, seperate bank acc or credit card acc statements (even it has only one name still confirms your joint residence address , so just put it..

-same way put any type of utility bills even it's just on your name still confirms your address, highlight the name and address.

-any drivers or non drivers photo ID of both on same page showing same address.

-if you can,just go to your local church get joint memebership letter.

-put some copies of checks from joint acc signed by either of you, (just go online print out copies of checks).

-put both of your cell phone bills showing same address ( say 2-3 copies for each year)

-get a notorized letter from your parents describing situation about the house & mortgage that you and your father bought & they r still living with you at the same house.

-go get a joint gym memebership if you can.

-put copy of any mail has your name or spouse's name on it, since it confirms joint residence address highlight the names and address.

-get few more (noterized) sworn affidavits from parents,family,friends, and if you can get a letter from your church about your attandence as married couple,how often they see you at church together etc.

My wife run a home based business...she has business cards printed but no letter head or anything else. I did include her income and deducted the expenses in our tax return for 2008. Should I send this information in with a letter stating the above.

Well, I think that the fact that you didn't send bank statements before but have them to send now for the past year are good. You can even send the ones prior to the past year (just one or two samples) and use a highlighter to show same address. What about investments? Any investments showing each other as beneficiaries?

As for the mortgage/lease issue, show a copy of the deed and highlight you and your dad as the owners, highlight the date, and then also submit 1. an addendum from you saying exactly what you wrote here and 2. a letter from your dad confirming what you have written. I would have the one from your dad notarized, but that's just me.

W2s are only needed if you do not submit tax transcripts.

I agree to resubmit your entire package of evidence, but you should note in your letter that you are doing just that.

Also, remember that many of the RFE letters are simply compiled of pat phrases that are pulled as appropriate and they may be asking you for something they already have from you ... regardless though .. send it again.

Well, I think that the fact that you didn't send bank statements before but have them to send now for the past year are good. You can even send the ones prior to the past year (just one or two samples) and use a highlighter to show same address. What about investments? Any investments showing each other as beneficiaries?
