Besides The actual I-864, this years most recent tax info and the accompaning W2, and the birth certificate showing that the joint sponsor is an american citizen, is there anything else that is required? soooo...

1) I-864 form signed and filled out

2) This year tax info and W2

3) Birth certificate proving citizenship

Is anything else required besides the above? It says that you can put in aletter from your employer, but it doesnt say it is required, and the joint sponsor makes more than enough above the 125% poverty line.

Some recent pay stubs to show current income and an employer letter are often included. That is the best way to prove the current income being claimed by the sponsor/cosponsor.

I'm sure you will need to give 3 years tax info too and make sure the I-864 is fully signed and i-864-A. We just helped my sister for a joint affidavit of support and so far she is here now 2 weeks ago.

You dont need the last three years, it says on the paperwork in item 25, (a box thatyou check) 'I have filed a federal tax return for each of the three most recent years. I have attached the required photocopy or transcript of my federal tax return FOR ONLY THE MOST RECENT TAX YEAR'

And what is an I-864-A?

I-864A is if the joint sponsor is a member of your household. If they live elsewhere, it's an I-864 just like your primary sponsor (spuse) fills out. If you use an official tax transcript from the IRS, it could be enough proof. With a tax return photocopy (make sure it's signed) and W2 statement, I would include one other proof like pay stubs or a letter from employer just to make it very clear to them and avoid any RFE questions.

A sponsor isn't required to send the last 3 years tax returns, but the sponsor is required to have filed for the past 3 years or included a letter stating why they were not required to file. By sending the past 3 year's returns (or transcripts) you leave no doubt as to whether the taxes were filed, thus avoiding a potential RFE.

The I-864A is used when a joint sponsor is a household member and their income is being combined with the principal sponsor's income. If your co-sponsor is not a household member then they would use the form I-864.

So pretty much just make sure my joint sponsor signs his tax return photocopy and w2 copies and include some recent pay stubs, and that should be enough? Because getting an employee letter would be difficult because the heart of his branch is in minneanapolis, and all the joint sponsor has access to is supervisors,

The directions doesnt say that a employees letter is required, but as long as he shows tax returns, w2s, and a couple of recent pay stubs including the most recent, i think that would be good enough. right?????

The instructions state that the sponsor must "must demonstrate that your income is at least 125 percent of the current Federal poverty guideline for your household size." How a sponsor chooses to demonstrate that is up to them.

Page 7 of the I-864 instructions also gives the examples that have been suggested to you. The recent pay stubs are good evidence. An employer letter is also good evidence.

In my opinion it is better to over prepare your submissions. The person evaluating the submission can only base their decision on what has been supplied. If they aren't satisfied, then an RFE can be issued and that delays your case.

thanks Anh map, my joint sponsor will supply alot of pay stubs, and this years tax info and w2s. I think if my sponsor supplies enough pay stubs and with the amount that the sponsor makes, i think it will be fine. Thanks again.

I know this is slightly off subject but I need to know, is it nessesary from myself (USC) to have a job in the states in order for the AOS to be approved?

I will have a co-sponser but I have an opportunity to teach English in Taiwan (where my fiance is from) and finding work here is slim pickings. So if I went back to Taiwan to teach English would they consider that as adequate employment. Thanks in advance!

No, because the employment needs to continue or be maintained after relocation to the USA occurs.

YMMV

I would go ahead and put in a letter from the employer of the joint sponsor. We did with our paperwork and I have read about people getting RFE's for not including a letter and or copy's of pay stubs.

Your original tow co-sponsers were required to & supplied letters from their company that stated they were perminate employees & their pay rates. Not sure why your father is not required to do the same thing we were.
