Green Card ~~ Last Name Change

Hello all...

We sucessfully received my wifes 2 year conditional Green Card, througout the whole process we kept her surname consistent with the documents we had on hand to submit, all the way from initial K1 Visa petition to I-485 filing to avoid any confusion or RFE's.

Everything worked perfectly, my question is now this, we want to start to get all her documents changed to her new married last name,

Her Philippine Passport ( We know how to do this one)

Her Social Security Card ( We know how to do this one)

Her Green Card... ( This one we are not sure of)

I was wondering if we can just request to have the last name changed when we file the paperwork to remove the conditions, so when she receives her 10 year card it will have her correct last name (married Name)

Anyone have a procedure for this or know what process to follow?

Hi Tim&Lanie,

If i read your post correct, your wife recently got her 2 Yr GC and now you want to have her name changed on the GC.

Have you received the GC or not. In either case, you will need to file form I-90, change her name. Follow the link below for the I-90 form and it's instructions.

If i read your post correct, your wife recently got her 2 Yr GC and now you want to have her name changed on the GC.

Have you received the GC or not. In either case, you will need to file form I-90, change her name. Follow the link below for the I-90 form and it's instructions.

I probably should have given a little more info as I was aware of the I-90, my angle was this, the filing fee for I-90 is $370.00...in a year or so we will have to file the I-751 to remove conditions, which carries a filing fee of $545.00.

My goal was to see if we could just do the last name change when we file the I-751, to avoid paying the $370 just to do a I-90 (seems like a waste just for a last name change) Thanks...TIM

Hi Tim,

The best option would had been if you had done your wife's name change when you filed I-130 as it asks for different names used etc. I know you want to kill 2 birds with one stone but as far my knowledge and observation goes it might not be possible with I-751 because they will use the name on the 2 YR GC etc for the 10 YR GC. So now you have 2 options either to do I-90 now or wait for the approval of I-751 and do the name change.

I haven't seen folks doing a name change during I-751, but I did see some do it after I-751 was approved and before they got their 10 YR card or when they were going to apply for naturalization.

I changed my name during the I-751 process. I did all the docs in my married name and stated where asked on the forms my maiden name. All the correspondences came in my new name.

3/27/06 Got Married - Whopeee!!!!!

4/06/06 Mailed I-130 only (Not ready to mail other documents yet)

4/12/06 NOA1 on I-130

7/20/06 Mailed AOS Package (I-485, I-765, I-864, no medical documents)

7/25/06 I-130 Approved

8/21/06 Completed Medical - $250.00 - Yikes!!!!

8/24/06 Received Medical report from Doctor

Ahhhh ..well I don't know if it matters but we did not file an I-130...we filed an I-129F....(K1 Fiancee Visa)..and we had to use her original maiden name because all the documentation had to match since we did not marry until she arrived here in the states......birth certificate, NSO documents, Passport....etc....etc...CENOMAR...

Yes..we are trying to kill two birds here....just wanted to know if it CAN be done....

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Here is my experience with Name Change

Filed I 485 back in 2006 under my maiden name. Just no to add any confusion with documents.

In 2008 filed I 751 under my married last name. Didn't file any I 90, cost $$$$$.

With the package wrote a cover letter that "please change my last name from maiden to married last name".

It worked. Got all mail since then under my new last name.

But can I change my SSN and driver's license to my married name even if my conditional green card is on my maiden name?

Anyone who has experience on this?

No you can't. When you get a job your SSN won't match your GC. You can't change your DL with your SSN in your maiden name (that I've been told).

You may as well just wait and try it all at the same time. MUCH less hassle that way.

Any idea as to which surname the green card will come with??

The U.S. marriage license signed with married surname.

Filed all documents with USCIS and NVC with the married name (included maiden name when asked for previous names used)

BUT my wife's Italian passport has her maiden name (Italian law will not allow for the surname to be changed).

The NVC uses her maiden name because her passport has the maiden name and the visa must match the passport.

Will the green card come with her married or maiden name?

Yes, you can. I changed my SSN to my married name. Received new card about a week later. Did an infopass to local USCIS office to ask about GC name change. They told me to wait until I file to remove conditions because it would take about 6 months for the new GC not to mention having to pay $$.

It should come with the married name.

The green card will come with the name you put on the USCIS forms.

We also did a name change after the 129f, had the driver license and SSN in the new name, and we're changing his name with USCIS on the I751. Just keep a copy of the name change document handy to explain the difference.
