RESIDENCE GRANTED AFTER 2 AOS DENIALS AND 1 WAIVER DENIED.

THIS IS MY CASE!

Fellows, for those with issues in AOS cases, keep the faith, be positive, and despite those moments of panic, believe that is possible.

Just wanted to share that Im so happy, blessed and Thankful. My AOS was denied twice and a waiver was denied too. As the last chance My lawyer used the "motion to reopen a case" with new and the strongest evidence I ever sent. (health related)

For the motion to reopen we waited 11 months and finally they revised the case again and the AOS is granted!!

Congratulations!

May I ask why you were denied the AOS twice?

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

May I ask why you were denied the AOS twice?

Hello, Maybe some of you wont believe what was the reason for all my journey, AOS denials, waiver and all.

This is what happened: Everything was going smoothly with my first AOS and the day of our interview I was nervous and I answered a "NO" by mistake in the "YES/NO" questions, almost at the end of the whole interview. Suddenly the interview stoped and the consul said, just wait to receive a letter.

2 days later, Just 2 days! I received a denial letter accusing me of "misrepresentation". I was devastated. The letter said I had 30 days to leave the country. I had to find a good lawyer in one week, and go for a 2nd AOS and a waiver, both sent at the same time.

After months we received the denials again. USCIS said the Hardship we claimed, was not extreme to the citizen, and 30 days was the deadline to leave the US.

Some weeks before the second denial, we experienced a devastating diagnostic in my husband's son and we documented new evidence and filed A "MOTION TO REOPEN BEFORE THE COMISSIONER"

So, this motion was to Reopen all the cases I belive. When I look into my portfolio online, they opened almost all my petitions, They revised the whole process again, and finally approved the second AOS or Waiver, maybe both; Im not sure.

I hope this situation never happens to anybody!
