I received an RFE today regarding IMBRA and I filed for the K-3 Visa. I didn't think it applied to those who were already married, but I guess it does.
Contrary to what my lawyer told me, yes it does affect all K-visas. K-1 and K-3! If you read the actual text of the IMBRA, it states all K-visas, plain and simple. No differentiation in K-1 or K-3. Though I've seen many people speculate that it's only for K-1, that is simply not true.

2005-08-10: Met Natalia and fell in love. Too bad she didn't.

2006-01-13: Married. Biggest mistake of my life.

2006-03-07: Began the I-130/I-129F process.

2006-11-01: POE - JFK / Home in Austin!

2006-11-15: She hits me and continues pattern of abuse.

2006-11-16: I filed for divorce.

2006-11-17: Wife is served divorce papers; she and daughter return to Russia.

2007-12-08: She returns to Russia "for the holidays" (lied to lawyers and court).

[many more ups and downs during this time period - mostly downs]

2008-03-26: File for bankruptcy.

2008-07-30: Bankruptcy finalized.

2008-08-27: Divorce final. Started piecing my life back together.

And also some of us that tried to show how K-3 were also included with the IMBRA. That really doesnt matter though now, all that matters is that RFE's are finally being sent out to all those waiting at NBC. Good to see.

I got my email July 3rd saying to look for my RFE, and I also got my 2 page RFE in the mail the same day.

Today July 5th I will return it.

By the way, I had the bonus of having to request a waiver. My wife and I had a K1 approved last year and it says if I ever had a K1 approved then I have to submit a request for a waiver, state why it is appropriate to get a waiver, and submit evidence.

sent my RFE back monday afternoon. have to admit though, i did like some others described and added a "hell no" (actually, just the "no" part) under Item #2 just to be perfectly clear.

does anyone else find that their instructions leave a bit of room for, uh, interpretation?

when someone finally posts an approved Post-Apocalypse, er, I mean post-IMBRA k-3 app,

i'm going to p a r - t a y . . .

maybe this week yeah?

got a case of heinekens chillin down, jus waiting.

actually, hold on. i think one of em's lookin' at me kind of funny... might have to do something about that.

I received an RFE today regarding IMBRA and I filed for the K-3 Visa. I didn't think it applied to those who were already married, but I guess it does. The first question on the letter specifically references your "fiance or spouse". Anywho, it was a simple enough document (unless you've got a criminal history) and I sent my reply today. We'll see what happens next....

Where did you enter "NO"? The instructions say to check all that apply if you have ever been convicted of those crimes against nature. I assumed if you had never done any of them and signed your name you were attesting to that fact.

The form also says I am legally able and intend to marry my fiance upon her arrival in the US - guess what - we're already married!!!! SO I guess that means all of us K-3 filers are committing purgery!!!!

I revieved an email notification for RFE 2 days ago... we don't know if we got the hard copy in the box by now coz my husband is with me here in Morocco.

We'll act as soon as he'll be back to USA... at least we are happy that our case has been touched, too :)

I received an email stating that an RFE was issued for the I-129F. I'm not sure if it's related to any of the recent events or if it's for some other reason, but at least it's been touched. Anyone else with a similar timeframe received the same?

Yeah I think your RFE has to do with the whoel IMBRA thing. I got mine recently too.

Yeah I think your RFE has to do with the whoel IMBRA thing. I got mine recently too.

You're so right! It was an IMBRA RFE. I checked 'NO' and signed. Then ran to the post office!
