My fiance come to USA on the 13 of March, her visa says it is good till Aug 18, 2009, but on a card stapled on the other side of the page it says the (I 94) say June 11 2009. We Met on June 12, 2008 we wanted to get married on that date. Would that be a problem?

the visa says August because she had 6 months to enter the country.

you must marry within 90 days of her entry though, which is June 11th unfortunately.

what about just getting married at the courthouse on the 11th to satisfy the paperwork side of things and then having a celebration on the 12th?

The date on the visa was how long it is valid. You have 6 months to use the visa. You have 90 days from entry into the US on a K1 to marry.

Yes, getting married on June 12 would be a problem. She needs to be married before June 11 or the K-1 status will no longer be valid for the next stage of her immigration process. If you marry June 12 then you will have to file an I-130 when she files the I-485 and she would adjust status under a different category than as a fiance. It will be a longer and more expensive process and she would have to explain at the interview why she let her I-94 expire before getting married. Basically, it is failing to fulfill the condition of the K-1 visa to get married within 90 days.

I know that you would like to have a special anniversary date for both your meeting and your marriage, but you will put so much at risk by waiting just that one extra day. She needs to be married BEFORE the I-94 card - the one that says June 11th - expires on June 11th. Why not get married before June 11 and have a special party to celebrate the marriage on June 12th instead?

You would need to marry within 90 days of her entry to the US. Otherwise, she is out of status and subject to being deported. Get married at the courthouse on the 11th and have a real wedding the next day.....

Yep, it is a problem.

Her visa was CANCELLED when she entered and replaced by the I-94 card. The date on the visa is the last date that visa would be valid to ENTER the USA. You must be married BEFORE the I-94 expires. June 10 or before. Sorry, neat idea. My wife and I were married exactly one year after we met, but it just worked out that way so we figured "why not"? It was never the plan per se.

It would probably be a good idea not to wait until the last day the I-94 is valid to get married. Delays can happen and you don't want to cause yourselves any problems.

My wife and I got married a little more than halfway through the 90 days. That way we had time to get married and submit the Adjustment of Status paperwork before her I-94 expired.

In my experience with USCIS they do not work very well with situations that are not by the book. I got a 7 month delay on my N-400 because of a change of address. You waited a long time to get this chance to be together with your loved one, I would take any precaution I could not to give it a chance for error or some kind of major delay. You could do the court papers early before a Justice of Peace officer and do the ceremony with the family on the 12th. Just my two cents...

I personally wouldn't leave it to the last minute.

God forbid something happened and you couldn't get married on that date.

eg:

You or your wife is sick

The person officiating cant get there

The courthouse goes up in flames and no one gets married that day.

Stupid, over the top examples. But examples none the less.

If you are OVER the 90 day period then you screw yourself over. Get married sooner rather than later. Dont put your future's in the balance for the sake of senitmentality. Be sensible about this. If you go over that 90 day mark, your in a whole lot of trouble when it comes to you trying to adjust your status as you have basically breached immigration laws.

A K-1 visa is a single entry visa for the sole purpose of beneficiary's admission into the United States for marriage to the petitioner within 90 days, making the beneficiary eligible to adjust their status to that of legal permanent resident. Failure to meet means the visa holder must leave the USA at the end of the 90 days.
