Hi all,

We chose the K1 process because it seemed faster than the K3 process, especially given the fact that it probably would have taken us a couple months to get married and finalize the paperwork in Brazil.

But not being married has its disadvantages... my Brazilian tourist visa is up, and I'll have to leave soon if I want to have some time on my visa left for the interview. (I know, staying illegally is an option, but I have to make at least short visits to the states this fall).

Can we still get a K1 visa if we get married in the meantime? Or does that mess up the process?

Once you marry - you will no longer be eligible for a K-1 (Fiancé) visa - you would need to start over with a spousal visa (K-3 or CR-1). So yes, it messes up the process.

Doing anything illegally should never be an option.

What do you mean your visa is up? Do you mean your I-94? or your actual visa?

Len answered your question about getting married.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Fiance visas aren't for married couples, as the name suggests. You both need to be single/divorced in order to be eligible.

K-1 TIMELINE:

05-11-2009: NOA1

05-20-2009: called the Military Help Line and requested for expedite

06-04-2009: NOA2

06-14-2009: NVC letter received in the mail

07-02-2009: Packet 4 received

08-27-2009: Interview - Visa approved!

09-03-2009: visa in hands.

09-20-2009: POE - Miami

09-21-2009: we got married!

AOS TIMELINE:

05-12-2010: NOA1

06-08-2010: Case transferred to CSC

06-21-2010: Biometrics

No you can not marry while waiting for a K-1 Visa. Sorry, but that is what a K-1 visa is for to come to the U.S. and marry. It would void you K-1 application and you would Loose the Fees and need to start a K-3 visa application. When and if they got around to voiding your K-1.

Being Illegal is NOT A OPTION. It could bar you from the U.S.A. for 5 to 10 years.

Curious if you came to the U.S.A. why didn't you just marry and do the Status Change AOS?

HEHE as long as they let you in the U.S.A. as visitor then GOT MARRIED there is nothing ILLEGAL about that.

I you don't tell and dont know you was going to MARRY (laughing) your friend.

anyway the K-1 Visa wait makes the Hearts grow stronger .. it really does. And if you document your Journey you will have something to share of how you met and what it took to be together for life.

Yeah, I meant in Brazil. And it's not especially illegal, you just pay a fine for each day you overstay, up to a maximum fine. They don't deport people, etc. The problem is that I would have to wait 6 months to reenter.

don't your credibility go down when you overstay, regardless who you are and where you overstay... :unsure:

Marriage voids the K-1 and you lose the fees and have to start all over again. If you have legal status in Brazil, you might want to check into the DCF option. This is for married couples and is a fairly fast route. You do need to be married, however, and the US citizen needs to have specific legal status in Brazil, usually for at least 6 months. If you meet this criteria you might want to consider a DCF. If you don't meet the DCF criteria, then no, don't get married and just continue with the K-1.
