I would send it they always want the most recent information ... but always better safe than sorry either way.

I'm almost certain you would need it. There were examples of individuals filling for K visas who were turned away at the embassy level for not having their 2008 returns. They were told that after the filing deadline passed they are/were expected to have the most recent information. Better to be safe and do it now!

Is it ok if you filed for an extension? We are using a co-sponsor, for whom we have transcripts from 2006-2008, because I live here in Colombia with my fiance. But I am obviously turning in my info too, and I figured it would be alright if I just printed out the 4868 Extension Request form, with the box checked for "living outside the US" and attached that with my transcripts from 2005, 2006, and 2007.

After April 15, you need to provide your return for the previous year or you need to show the request for extension.

Should someone ever read this thread at a much later date (hopeful, I know), Between January 1 and April 15, the immediately previous year's return is not technically needed, but the closer it is to April 15, the more likely it is that COs would like to see it. (say on April 14th...).

As it is well past the filing deadline for the 2008 tax returns if you owed the IRS money you should send your husband a copy. The consulate has the right to ask for it during the interview. Better to be safe than sorry at this stage in the game.
