Can you find out what the "bad marks" are? Freedom of information and all? Or is it just that her name is common...

*sigh*

I don't know what to tell you other than that maybe policies will change, or the process will change, or they'll catch the international super-spy who shares a name with your wife or whatever the problem is and something will shake loose.

But we're all still rooting for you guys to get the visa now. File the waiver and see what happens - it seems like she's going to have to take the doctor who delivered her to the consulate to prove that she is who they say she is (since the letter wasn't enough).

And maybe it's confusing because you say the same thing over and over instead of changing your story, which seems to be their way of operating (at least with your case).

We all know what the USCIS is about and are all irritated with them but... they DO do their job eventually and the do NOT hold people back just for the fun of it, this we know.

GoGo? What ARE these marks on your wife's record/name or whatever? There has to be something of significance for your file to be hold back for so long and without any sort of reprieve.

I'll hold back on the attacks until I make sure we have no more path to choose.. at least the DD should know exactly what is going on.. :thumbs: I think there was a bad mark because she was divorced before.. that is all.. she got divorced in 2006, but I knew her in 2005.. they had a divorce because the other guy was cheating.. we got married in March 2007.. maybe it was too quick??

Well, if she's never been to the US that should be easy to dispute, especially considering the fingerprinting/passport swiping/visa requirements. Do they have some sort of entry record for her? Could it be misrepresentation on another part of the application? You guys have filled out so many forms that it would be easy to cross dates somewhere.

we don't know yet.. but I believe the I-601 waiver notice will not say anything more than I already said.. about the "misrepresentation" code.. it will arrive in a few days and I will see what to do.. I already sent in a FOIA request, and the max fee I am willing to do is $1,000. hehe, a little too much? their maximum was $25.. I am willing to put that much just for copies if they can give me a copy of EVERYTHING they have on her.. :devil:

You know you'll probably get back a copy of EVERY email/letter/form you've ever sent and then at the bottom of the pile there will be an entry record for some 60 year old grandma with the same name as your wife who didn't leave on time because her grandbaby was born a week later than expected...

I'm sure you'll get it resolved. As dedicated as you both seem to be, I think they'll figure it out one of these days.

:( I think about that sometimes, too - the time we aren't spending together now. I guess that it'll help to look back once this is all over and remember to appreciate the time we have. Also, I'm working to try and enjoy the time I have with my family now, in case things don't work out and I end up moving instead of him.
