So back in December we received a RFE...we sent pictures back for proof of meeting prior to the 2yrs before filing.... my fiancee sent it by USPS due to a lack of 13 cents for postage it got mailed back to him but WELL after the cutoff date for the initial RFE....he then received an "ABANDONED" case letter explaining the application had been abandoned and now closed

We called and tried to speak with someone to explain what had happened and got no info other than now we would have to come up with $575 to reopen our file and IF they approved it (just to reopen) then it would have to fall under some guidelines etc...Well we sent in the money and the file was reopened now the initial evidence asked for back in December we had sent in (pictures) we asked for again 1 MONTH ago....we have not heard or have they notified us that they received the RFE evidence .....but we have confirmation of them receiving via courier..... the cut off date was April 16th to send in the pictures!

I am due in 6 days...our baby was conceived in July...we sent in the I129 in October....do you think we met prior to the 2 yrs of filing?!!!!!LOL.....do the math are the USCIS people that dumb?....and I sent in a copy of my I94 which is a hard copy out of my passport dated Aug 08, which is primary evidence over some pictures!!!!!!!!

Anyways im getting really fed up with this...and you get NO WHERE calling into the USCIS.... just some stupid operator that knows nothing!!!!!

Sorry to hear you had such bad luck. 13 cents jeeze. If it wasnt so important and people's lives were at stake, the irony would be funny. In this case, its a 'JUST MY LUCK' case.

Good luck with the birth in 6 days, can't say much about that since I haven't had any yet.

I have zero sympathy for people who place inadequate postage on mailed items, let alone something so crucial.

However, when you next call USCIS and reach the Customer Disservice representative, INSIST on being escalated to an immigration officer. The rep will object to this. Stand your ground. State that the rep is required to transfer you upon your request. If you get further flak, ask "How am I wrong? What was your name and ID number again?" Only when you are transferred to an IO will you get any meaningful or valid information. And, good luck with the impending birth.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

On the RFE when it requested the information for pictures ...it does not state if we do not receive the information by that date it preceeds to an "ABANDONED" case!!! and I was told that USCIS "that we have people trained to send the envelope back due to a lack of 13cents"....see my problem is that California received it but then sent it back to us!!!! your telling me they could not have notified us I would have sent a instant payment for 13 cents!!!! even drove down there ...but yes my fiancee learned an expensive lesson :blush:

And I would be happy to provide a DNA test....thats what I am waiting for them to ask for next that or my first born ....but thats not for a few days bahaha.....

Undeniable rule of life #12 "Whenever sending anything for any reason to any government office (even the dog catcher) use certified mail and go inside and pay the postage and receive a return receipt when it is delivered."

Now, I am sorry for your, um, misfortune, but your fiance shot himself squarely in the foot by not sending adequate proof, then reloaded and fired into the other foot by not using correct postage and certified mail, then shot himself in the left kneecap by not following up (or having a means to follow up) on delivery, BUT he did save 13 cents. I agree completely that the USCIS can be more useless than a brick to talk to, all the more reason to cover your *** when you send them something. Hopefully he will cease fire before he can't walk anymore.

In this case, boiled down to the essentials, the USPS did what they should and normally do, return a package with insufficient postage and USCIS did what they should and normally do, close a case with no response to an RFE. The fault lies squarely on your USC fiance.

I wish you luck in straightening this out, hopefully paying $575 to re-open the case will get it done most quickly. And you can be together soon after the baby is born. Good luck

recently I had a RFE for my wife I751 removal of conditions.

I got the proof and when I sent it off, I went into the post office and I did proiotty with proof of deliverly and sign.

We got a letter today that she is approved and will get her 10 year green card in the next 60 days

Firstly, I agree with all responses that any failures to ensure adequate postage are not USCIS or USPS responsibility.

I wanted to chime in on another topic I didn't see raised by any responders... see the bold text above.

You write "proof of meeting prior to the 2yrs before filing" .... surely you mean "proof of meeting WITHIN 2 years before filing"??

Since that is the filing requirement?

It seems to be just a typo in your post, but since you repeated it twice, I thought I'd point it out to you.

It would be awful if your USC fiance had (to use Gary's terms) reloaded his extremely dangerous weapon and proceeded to fire at his (*ahem*) b@11s by providing evidence that you met a decade ago, but not within the past 24 months!

B@11s! Oh heaven forbid! He's a couple of reloads away from getting that high! But regarding the baby, simply stating you are in possession of a "bun in the oven" is not primary evidence you met HIM within the last two years, unless he also submitted DNA evidence that the child (fetus) is his. I am not questioning the fact (congratulations, by the way) but the USCIS cannot be expected to assume that. Really, some photos of you together and travel documents are much better.
