Will I EVER get to USA?

Hello, Im just throwing some ?s out there bcz I didnt read the whole thread yet...

Did you move to another address since you received the notice of action of pending from I130?

I thought security checks were done after the interviews.

I thought you said the I129f was dropped, I think (dont know if its right though) that if I130 is going forward then it wouldnt be a K3 but a CR1...

plus, I would suggest that ya'll dont let any more months pass by... contact people daily/ weekly. Keep asking, keep calling, keep questioning!

and dont give up!

- No, I haven't changed my address since August 2007, which was before we even got married. Our visa process started in February 2008. My husband hasn't moved either.

- I'm sure there'll be more security checks after the interviews, but right now our case is going through FBI name check which apparently is something every application goes through "early on".

- As far as I know the I-129F was dropped, because it would've been pointless to start fixing it at the point where we found out our names were still wrong in it. It had already been sitting at the USCIS for over 6 months, doing nothing. I'm not even sure myself now as to what this all is going to lead to, but that once I-130 is approved and I'll be able to get to go to USA I don't need to pay any extra for a green card or anything and I should be able to get it within a month.

I have worked MY BUTT OFF trying to get this case to go somewhere. I've contacted everyone I could've thought but every time I contact these people I get the same answers. When I call the USCIS they only tell me that the case was received in April 2008. To my husband they tell that the case is still with the FBI. When I call the congressman's immigration specialist, she says that all she can do is keep sending them an inquiry once a month. She tells us to just wait. The USCIS tells us to wait. The US Embassy tells me to wait. The Embassy still can't understand what is taking this long as they were sure I'd have my visa in October 2008.

Right now this whole immigration business is only driving me and my husband insane, because as it is, we're not able to get to talk to each other much due to our schedules and the time difference. The only thing I've been managing to talk is this immigration because I haven't had anything else going on in my life. We've decided to stop discussing it for now and focus on how I could go see him in the USA instead. Nobody knows how many more months, or years this case is going to take and we're going to need to spend some time together, enjoy a REAL relationship for a change and live as normally as possible, without constantly stressing over this.

I registered on the USCIS website myself now finally and added the portfolio, wasn't sure if I could do that but apparently so. From there I could see that the case was last updated 03/03/2009, so I guess someone has at least looked at it? Is there any way I could get to see the previous updates as I haven't found a way to do that yet...?

That's good! Hopefully 3/3 it was given to an adjudicator, or at least put into the work que.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thats good news. At least you aren't lost in the system. They do, at least, have your file.

12/14/09: Green Card arrived in mail. Happy Days!

It's taken 18 months from applying for K1 to receipt of Green Card! Thank God it's over until 12/7/11

We filed our application for a k-3 in mid-september 08 for my wife (a Dane). We went to the interview in copenhagen last week. She was approved. It took one hour to go over the paper work and about 5 minutes for the actual interview, if that long. Roughly speaking, we are about twice your age. We had a lawyer in the US help us with the paper work. Expensive but in the end probably worth the investment. I can only suggest that you and your husband keep calling and pushing for answers. As for traveling to the US, my lawyer strongly discouraged us from considering it (she is very cautious about everything). On the other hand, many here in this forum have done it with no problem; but apparently there is a risk, according to my lawyer, that could result in a delay in processing your visa.

Well right now I don't know if it even matters. The delays. It has already been a year after all. It seems that the common opinion of everyone in the USA is for me to not even try to go visit, where as the Embassy here says it shouldn't be a problem. I'm trying to bribe my husband into just moving to Europe to be with me as this is getting beyond ridiculous. I don't personally care where we live, as long as we can be together, I was just trying to move to USA to make life easier for HIM. So he wouldn't have to drop everything and learn a whole new language.

I just wish we would've known 2 years ago what we know now.

That's today. Been an exact year since we received our NOA1. Now I'm officially able to start worrying, with USCIS' permission. Thanks for that.

Anyway, no news on my situation. Still stuck sleeping on my parents' couch, unable to to see my husband, still haven't managed a definate answer on anything. I wish I'd have SOME KIND of an estimate on how many more months this CAN take. Like... are we talking 2 months or 6 here? Or should we talk about years instead? I'd also want a CERTAIN answer on if I can go to USA to visit him or not. The US embassy in Helsinki says I'm free to go visit him all I please, tourism is allowed to USA even while my I-130 is pending. Most of the people here on the forums say it'll be fine. EVERY officer in USA however seems to think it's a really bad idea to even go give it a shot. With answers as conflict as this, I don't know what the heck I'm supposed to do. I haven't even got a 100% certain answer for if my trip to USA would hinder our I-130 process, should I get sent home. This uncertainty is killing me.

Our case was just touched AGAIN on 13th of April 2009, but nothing is happening. Still "case received and pending". Are they touching it even though it's supposedly STILL with the FBI? What's going on...

Sorry to hear about your situation.

I would suggest to send a fax to the dept of State and tell them that you wish to visit your husband and can they guarantee that you will be allowed to enter as long as you show strong ties to your home country. Or, you could always apply for a B2 tourist visa.

I am astounded and quite frankly very disappointed in this system that allows some petitioners to be adjudicated in weeks and others over a year. There can be no excuse for you being treated in this manner. Apart from the disruption to your life, time and opportunity's wasted it is also the emotional distress you have suffered.

We do hope you are approved VERY shortly. It is inhumane to treat people in this manner and I feel you have every right to feel aggrieved. You have our utmost sympathy for your duress.

If can show strong ties back to the home country, and meet the eligibility requirments for the VWP, then you can visit.

VWP

Is there a chance you will be denied at the POE? yes, but all visa holders have that chance.

Umit has visited me twice, using a visitors visa, and one of those times was after we applied for the K-1, and she even told the CBP Officer we were in process of the K-1, and she was given 6 months to visit.

They just wanted to see her return ticket info. (She had a letter from her boss explaining it was a vacation, info showing apartment lease, and a copy of our NOA1/K-1 info).

Now, will our experience be yours? You won't know till you try.

So it's up to you if you want to visit.

Touches means someone is doing something with your file. They could be moving it to new location, acting on it, sending it down the chain of command, etc. Touches are good, means they are working on it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I can't show very strong ties to Finland as I live at my parents' (for free) and I don't have a permanent job here (not that any job would just give me 3 months of holiday anyway. I do still have a good deal of my belongings here and of course my family, friends and my dog. All I can say for myself that I'm not so stupid that I would've just gone through all these months of ####### to risk it now. And of course I would have a return ticket.

The reason why I'm not very optimistic is... because an officer at the airport threatened me the last time I visited USA. Back then I wasn't even married yet, I was just visiting with my visa waiver - for the 2nd time that year. This was apparently too much for the officer in question who was upset that I could go and stay with my boyfriend for 3 months when all he got was 2 weeks in Mexico. He accused me of basically being lazy, useless and a burden to my boyfriend - despite the fact that I came so that he'd have easier time adjusting to a life outside his parents' home, in his new place. I also had several hundreds of dollars of money with me AND a credit card with 1000 euros as a limit, which back then was around 1500 dollars. He told me that if I'd try to come again with my visa waiver "any time soon", I'd most likely be sent home - even though they don't really have any right to do that. It has now been more than 1,5 years since I was last in USA, but what if I go there and get someone like him again at the airport? Someone who just wants to send me home OUT OF SPITE?

Sad to say, that could happen - sometimes you get a bad CBP Officer. I hope you sent in a complaint.

Return ticket is good evidence. Some people don't even have that much and are still allowed in.

I thoroughly understand your unwillingness to risk the purchase of a flight with no guarantee you will be able to fly. I am sure the flight from Finland is not cheap. In your personal situation I too would be unwilling to risk it given the implications that could arise.

I do think you will not be long in getting an approval, it just seems that you have indeed waited for a long time.
