Surveillance video released in an assault case against a King County, Wash., sheriff’s deputy shows a deputy kicking a 15-year-old girl, slamming her to the floor of a jail cell, striking her and pulling her hair.

The footage shows the attack beginning after the girl enters the cell and kicks off one of her shoes toward the deputy.

The video released Friday [02-27-09] is part of an assault case in which Deputy Paul Schene, 31, is accused of using excessive force on the girl, who was being held in a cell at the suburban SeaTac City Hall. Schene, who is charged with fourth-degree assault, pleaded not guilty on Thursday [02-26-09] in Superior Court.

The incident last November began after the girl was brought in for an auto theft investigation, according to court documents.

“We believe this case is beyond just police misconduct, it’s criminal misconduct,” King County Prosecutor Daniel Satterberg said. “This is clearly excessive force.”

Satterberg added the case is uncommon because cameras captured the entire incident.

Schene was investigated previously for shooting two people — killing one — in “the line of duty” in 2002 and 2006. Both times his actions were found to be justified, said Ian Goodhew, prosecutor’s deputy chief of staff.

In the video, a deputy kicks the girl, pushing her back toward the wall. The deputy then strongly backs the girl against the wall, and slams her to the floor by grabbing her hair. A second deputy enters the holding cell, while the first deputy holds the girl face down to the floor. The first deputy appears to hit the girl with his hands. The girl is then lifted up and led out of the cell while the first deputy holds her hair.

Schene then lunged through the door and kicked her, striking either her stomach or upper thigh area, court documents say. He pushed her against a corner wall before flinging her to the floor by her hair. He then squatted down on her and made "two overhead strikes," although it's unclear where the blows landed.

The detective who reviewed the video said it appeared Schene and Brunner had the girl under control when Schene struck her. Schene, who is 6 feet 2 and weighs 195 pounds, did not explain his action to investigators, court documents say.

He and the girl exchanged words. Brunner said she was "real lippy" after being informed she was under arrest and called them "fat pigs."

The Sheriff's Office policy manual says deputies should use physical or deadly force only when "necessary to effect an arrest, to defend themselves or others from violence, or to otherwise accomplish police duties according to law."

While it's encouraging that Schene has been criminally charged, he faces a maximum of a year in prison for assaulting a prisoner -- a teenage girl -- who was under his power as an officer of the law. Can you imagine that the charges and potential penalty would be so lenient if a random Seattle resident had locked Schene in a room and given the deputy a beating?

I would suggest that a police officer should be punished more harshly for committing a crime in the course of his duties. That uniform and badge have to come with a heightened -- not a lessened -- degree of responsibility or they're just a license to commit mayhem.

Interestingly, Schene nearly died in a bizarre traffic accident involving his police cruiser in 2005. After crashing into a minivan and then hitting a wall, he was pulled from the official vehicle by a returned Iraq vet moments before the car burst into flame.

He also has been involved in two shootings, including a 2007 incident involving Pedro Jo who died after being shot 11 times.

I've written, speculatively, in the past, that the growing prevalence of surveillance cameras, cell phone cameras and the like might help to curb some of the worst abuses of government officials. No matter how brutal or corrupt any given person may be, how likely are they to do their worst when their acts are guaranteed to be recorded, uploaded to YouTube and produced at their trials?

Well, if they're like Schene, maybe there's just no such thing as a deterrent. If the fixed security cameras that you see every day in an official facility, which are monitored by other police officers, don't cause you to think twice, nothing will.

At least, though, we have the evidence for the trial.

I'll save you the trouble...FAIL. It wouldn't matter if she burned down Tokyo and beheaded all but two of the deputies in that facility, the actions of the deputy were not legal, they were not necessary, and he violated the public trust. Execute him on live TV, and sue his employers.

This Deputy should be used as an example of public authority training at the academy. Do they even teach ethics in the Academy?

Lawyers, Doctors, Engineers, Physicist, etc...requires an ethical course in college.
