Timeline

Since we are doing the whole DNA thing by the time we are finished it will be March and my husband and i will be married 2 years in June? I know it's a stretch but do you think that it's possible for him to get the 10 year green card instead of the 2 year? It will be so close. It would save us some money if they would. Is there a way to request that since it is so close to our 2nd anniversary?

I think it matters when POE is, not issuance date of visa - we are in the same position. I think you ask for the IR-1 stamp at POE instead of CR-1. Please anybody correct me if I'm wrong but I think it's that simple. Govi will be coming back with me through POE in July, after our 2 year anniversary date. At least this is the plan, God willing....

You are correct, but sometimes POE officials refuse to stamp IR-1 even though beneficiary is entering US after 2 year wedding anniversary.

Basically its a chance you take and depend upon the POE officer.

You are correct. It depends on the date of actication of the visa not issuance . However, I have read psots where the agent at the POE was not familiar with the process and the visa had to be adjusted from CR-1 to IR-1 after entry.

When is your husband planning on POE?

If it is before your 2 year anniversary, no matter how close it may be, he will not be eligible for the 10 year greencard.

what if a day after the anniversary? will they give 10 yera green card?

On or after the two-year anniversary, entry with a CR1 visa results in IR1 status. If the POE makes an error, it can be corrected.

Visa issue matters too. If the visa is issued on or after the second anniversary, the visa itself will say IR1 instead of CR1, as will the green card.

There's no fudging. If you have a CR1 visa and want a 10 year card, you wait until you're entitled to it before entering the USA.

My wife and I are in the same situation, she will probably receive her visa in April and our 2 yr will be May so we will come to the states in June just to make sure we have passed the IR-1 requirement. I told her to also have an original copy of the marriage contract in her carry on bag just to be able to produce proof of 2 yrs at POE.

Depends on visa issuance category..If your visa says CR1 you need to wait until you have been in the US for 2 years and then remove the condition 90 days before expiry.

The only way to guarantee IR1 is to have your VISA issued after your 2 year marriage anniversary.

Thank you very much. We are actually done with the DNA testing as of today. The results are actually on the way to the embassy via fedex today. It was hard but we started the ball rolling right after the interview and therefore now we are done. They will issue is visa once they recieve the results.
