I'm a US Citizen and filed AOS for my father. I submitted the following forms and fees:

I-130 $355

I-485 $1080 ( $930 + $80 Biometrics + $70 Department of State I-864 Affidavit of Support Filing Fee)

I-765 $0

I just got 3 Denial letters today and can't understand why:

1) I-130 "The check amount is incorrect or has not been provided. The correct filing fee is $355."

2) I-485 "The check amount is incorrect or has not been provided. The correct filing fee is $930. Each applicant between the ages of 14 and 79 must also include an additional $80.00 fingerprint fee."

3) I-765 "The check amount is incorrect or has not been provided. The correct filing fee is $340."

Can anyone see why my filing fee is incorrect? Maybe the $70 Department of State fee for I-864 should be written on a third separate check instead of lumping together with the I-485 check?

I also can't figure out why they are asking $340 for the I-765 when their instructions say there is no fee when filing concurrently with I-485.

Frustrating!!!

the filing fee is one set fee for AOS its $1010

just write one check for that amount when you submit all paperwork together.

01/08/08 Honeymoon in England

06/04/08 Returned to USA from honeymoon (nice long honeymoon)

07/01/08 Find out immigration attorney had told us to file wrong paperwork. So we call USCIS and they advise what paperwork we need to file.

08/26/08 AOS paperwork sent to USCIS (I-485, I-864, I-765) $1010

AOS paperwork submitted to wrong address....so resumbitted to correct address....(thanks uscis customer service line...NOT)

09/09/08 AOS paperwork resubmitted to correct address

09/15/08 Notice that I-485, I-765 received by USCIS on 9/11/08

09/17/08 Letter received giving date of Biometrics appointment

10/01/08 Biometrics done

10/10/08 Case on hold. USCIS requested I-693 (medical exam & Vaccination report)

12/30/08 I-693 sent to USCIS

02/02/09 received letter from USCIS to attend initial interview

03/05/09 initial interview at Sacramento Office

21/21/10 filed for removal of conditions

1/10/11 received letter for biometric appointment

2/10/11 biometric appointment

04/01/11 rceived letter asking for additional information of joint assets and or proof we are a legit couple.

05/02/11 received letter to say they will notify us of date of interview.

the filing fee is one set fee for AOS its $1010

just write one check for that amount when you submit all paperwork together.

Yeah! that's right. me i got two checks the other one i wrote is $1,000 and the other is $10..that's all.

The correct fee would be:

AOS Packet including AP and EAD + Biometrics = $1010.00

I-130 = $355.00

There should be 2 checks One for $1010.00 attached to the AOS packet and one for $355.00 attached to the I-130. Everything goes in one envelope and is mailed to the Chicago Lockbox.

Also make sure you have the correct options selected on the I-485 and the I-130.

I-485 - $1,010 ($930 & $80) AOS fee is only if applying for an immigrant visa via NVC not for the greencard

The $340 was requested because the I-485 was rejected because you need an I485 in the system to get an I-765 at no fee

Thanks a lot for all the feedback. So it sounds like my application was denied because I paid $1080 instead of $1010 for the I-485. Now my question is the fee for the I-864. The instructions for I-864 say "Although USCIS does not charge a fee for this form, the Department of State does charge a fee of $70 when the Affidavit of Support is reviewed domestically. This does not apply when the Affidavit of Support is filed abroad." Does this mean I need to include a third check for $70 ( also made payable to US Dept of Homeland Security )with my packet or should I not include the $70 because they will ask for it later?

No, Dept. of State has nothing to do with an AOS case. Two checks, as described above.

Neither, since you are only dealing with the USCIS and the the USCIS does not charge a fee

the filing fee confused me to. i thought it was 1,080 bucks. got thing i consulted on here before i sent the package.

AOS package sent - 1/30/09

AOS package recieve (IL)- 2/2/09

NOA for all applications- 2/9/09

Biometrics Appoint Notice recieved 2/2/09 for 3/9/09 will try walk in 2/25/09

RFE's for co sponser w2 and 1099, birth certificate, i-693, and immunization recieve 2/15/08

Just adding this to anyone searching the forums and having the same issue: you DO NOT add a check for the Dept of State $70 fee. At the USCIS website, it directs you to the State Dept website which states they will send you a bill for that amount, when and if the application reaches them, AFTER USCIS is done.

So as the previous posters stated, you simply send one check for $1010 and one for $355.

I am going through this process

I filed this month for I 485 , I 785 and I 131

All for just one check of $ 1010 no more.

Just received all three NOA1 receipts today in the mail.

one for each of the three aplications

if you are filing for I 785 or/and I 131 separate and after you filed for I 485, Please include a copy of NOA1 you received from I 485.

In other words . there is NO fee for I 785 and I 131 if you are filing or filed for I 485.

It's my understanding that the fee for the I-864 is waived because the casefile is totally adjudicated in the USA.

So not need that extra 70 bucks.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

And, the checks are made out payable to "Department of Homeland Security" . No abbreviations or variations allowed. You can pull an RFE for just that.
