:) Hi

Does anyone know what the deal is with the military benefits on USCIS homepage? There's a section there under FAQ's stating that military personnel can request expedited processing of their peditions. Is this just for active duty or any serving soldier etc??

Expedites are usually, not always though, granted for those about to go on deployment or those on deployment. If you think you are eligable you can always give them a call on the number provided to check.

Military personnel is military personnel. If you are serving in the military, I think you are entitled to military benefits whether you are on active duty, deployment, or the reserves. Call the USCIS customer service number on the back of your NOA1 and see what they say. They will ask you if you are in the military when you call to inquire about your case. They won't tell you anything that isn't already on the USCIS website, but if you can't find it or you tend not to be a fan of reading through the entire site, they're good for that :) Just remember that basically none of the customer service reps have ANY CLUE about the immigration process, so if they seem confused, it's normal. ;)

Military personnel is military personnel. If you are serving in the military, I think you are entitled to military benefits whether you are on active duty, deployment, or the reserves. Call the USCIS customer service number on the back of your NOA1 and see what they say. They will ask you if you are in the military when you call to inquire about your case. I agree with you, the only thing the reps know is what's showing on USCIS website and 95%, correction 99.999999% of the time, what's on the website is outdated information.

From my experience with USCIS, if you were active duty, reserve, guard, it wouldn't matter, they just ask if you are in the military, I can't recall them asking specifically if I am AD, Res, or Guard. The only thing is, you have call between I believe 7am and 430pm local time, if after 430pm, then you won't get any help. I called just after 430pm and the lady told me since I am military she can't help me, I have to call back between those designated hours, then she kept asking me if there's anything else she can help me with, I just told her come on lady, you're just going to tell me since I'm military you can't help and I should call back during those hours, so she laughed (in a friendly manner) and that was the end of the call.

I was told it could really help if you can get a signed letter from your Commander, a really strong letter. I submitted a letter to my Group Commander for his signature and was told there's a way of writing the letter strong enough to push the petition through the entire process. As soon as I get my hands on it and if it actually does work, I'll post it. There's also AILA MAPs, it's a program that has a group of Immigration Attorney's who volunteer their Immigration legal services to military personnel for free. They'll try to find lawyers in your area, the closest volunteer for us is in another state but that's what email is for right? My lawyer has been really helpful in my case, although you have to understand they are paid lawyers so in some cases your case would not get full attention since it's being handled for free.

Just call the Military USCIS number. They will ask you about your situation and they will tell you right the way if u are eligible for expedite process. Good Luck!

Further to my previous post, my fiance and I got our NOA2 approval on Monday. We requested an expedite over the phone on the military helpline and they just asked him a few questions, ie does he have current orders. My fiance explained to them it was likely he'd be deployed in the fall and they said we'd hear within 6 working days if an expedite would be approved. The following working day he received an email requesting a faxed copy of his military id and then a further 5 working days later we got the NOA2 email. I was surprised they approved it without his orders, but hey it just proves what I always say 'DON'T ASK DON'T GET!'

We lodged our I-129 in mid December, so I was quite pleased our application is now on it's way to NVC and hopefully will be in Sydney by the end of this month.

I am actually in the same situation what exactly did you say to USCIS I requested it once and am near my 60 day window of reappyling for expedite....your help would be greatly appreciated

Active duty or Guard or Reserves, as long as you are in a deployed location, I received expedited K-1 visa while I was deployed, I faxed in my orders and the next day we were approved, but that was the only expedited thing about it, everyhting else took its normal time frame

We call the Benefits for the military personnel at this number 1-877-247-4645 and my fiance talk to the guy there and ask about the petition and they said we got approve and wait for the letter...We been waiting for the approval for a while actually 5 months on sept 26 and finally we got approve by the help of them..it havent posted at the USCIS though that we got approve but the guy who my fiance talked to said that wait for it and it get updated soon...goodluck to US and for those who's still waiting on their approval :star:

so now if your military you can "think" your going to be deployed and get an expidite. theres something wrong with that imo
