Is it possible, under any circumstances, to extend a fiance visa once the fiance is in the US?

It has been about two months and we still feel like we need more time to get to know each other and make decisions that will shape the rest of our lives. With only a month left, we are grabbing for any and all straws.

Short answer is no... you must marry within 90 days. I'm pretty sure that's not a waiverable limit.

Short answer is no... you must marry within 90 days. I'm pretty sure that's not a waiverable limit.

No, the visa cannot be extended. You marry within 90 days or the visa expires and the foreign fiance is out of status. It is possible to marry after the 90 days and start the AOS process with an I-130 but if the foreigner overstays and doesn't marry the petitioner there are consequiences.

I third that. Why if you needed more time to get to know each other, did you file for the fiancé visa that is intended for marriage??

If you needed more time to know each other and not sure then you should have maybe visited on a waiver or something and THEN made the decision to marry when you both were ready.

It seems like a waste of time and money to do that.

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

You should of made the decision of marriage before you submitted your K1 Visa Application.

As stated many times already, you can't extend the visa. I don't know why however, if you're still not sure, that they couldn't return to their home country and you could file again at some future date if you both decide later that this is something you still want. I've seen a few couples on VJ do this. It would mean continuing a long distance relationship even longer, but it will give you both some breathing room to do some more communicating.

If at all possible, perhaps the USC could live in the beneficiary's country for an extended period as well before deciding on whether you wanted to get another K-1.

It is not the visa that would need extending (because it has already been used and therefore no longer valid), but the authorized stay or status period as indicated on the I-94.

As others have said... this cannot be extended....

I don't think the OP was looking for judgement on his/her relationship. Please keep those kinds of comments to yourself as they do not help anybody.

To the OP, you got great advice from some good people already but I will add that if you are not absolutely sure they perhaps you should give it more time and file again at a later date. You are correct and wise to assume that marriage should not be taken lightly. Your 'fiance' will have to return to his/her home Country before the I-94 expiration at 90 days.

Time for some soul searching.
