You DEFINITELY need to follow this up. I would call them tomorrow first thing. The reason I say this is because of the receipt number: LIN0605352998. It starts with LIN - which is Lincoln, Nebraska. Unless Texas has started sending its I-129F's to Nebraska (which I suppose would explain the sudden recent slowdown in Nebraska), you need to follow up and find out why your petition is in the wrong service center.

i hired a lawyer and he sent our package to Nebraska (his mistake) on 12/12/05. that is why i have a LIN case #. Then on 12/21/05 i receive a letter that it was being sent to TX for 'better' processing. Then i heard all the TX cases were switched to CA.

So, this letter states it is 90-120 days now! My clock should have started on 12/12/05!!! that is what is so frustating!!

thanks for eveyone's input,

Hi Laurenzi,

There are some serious issues here. According to your timeline your service center is Nebraska (NSC) if your name is John.

On your thread it show you out of Jacksonville, Florida which would make your service center Texas (TSC) which off course mean that it will be transfer to CSC because you are a K-1.

But your receipt number starts with “LIN” (LIN0605352998). Nothing makes sense here because if you were going through CSC/TSC like me your receipt number would start with “WAC”.

Please correct your timeline also call and e-mail your service center because something are definitely wrong here or please give us an explanation.

Good luck,

Yeah its 'wrong' but its also 'right'.

Your timeline starts from when YOUR service center receives the paperwork - which *is* TSC/CSC

Your representative seems to have set you back by 28 days because he/she sent it to the wrong center (get a refund if you can from him - you pay for his expertise, so this mistake should NOT have happened, its just a matter of looking up info on the USCIS website for heaven's sake - its not even case law related).

I don't think there's really a lot you can do now - as for the reference number they 'ought' to assign a new one now its in the right place.

Best of luck and a speedy passage thru the system in spite of this slow start.

Another fine example of a lawyers screw up costing you time AND money. Does this answer the often asked question of "should I use a lawyer?"

And what's more, it's not the first time I've heard (here, on VJ!) of lawyers making exactly that mistake. It's unforgivable.

Unfortunately, my experience (with two different US law firms specializing only in US Immigration) is that the "specialized knowledge" that immigration attorneys have, can be extracted in a simple consultation, and that any layperson can do the form-filling as good as, or (usually) better than, the lawyers.

The level of utter incompetence I encountered dealing with immigration attorneys left me many thousands of dollars poorer, no visa in hand, and very seriously considering sueing one of the firms for the long list of errors they made on my behalf. Had I followed their recommendations without first seeking a second opinion, I would have been charged with fraud.

BOTH of the firms came highly recommended from another, trusted, attorney.
