Here is the criteria for an expedite on visas:

http://www.uscis.gov/portal/site/uscis/men...0000ecd190aRCRD

All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The criteria are as follows:

  • Severe financial loss to company or individual
  • Extreme emergent situation
  • Humanitarian situation
  • Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States
  • Department of Defense of National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)
  • USCIS error
  • Compelling interest of USCIS
If your case is at a local office at the time you need to make your emergency request, please go to the local office in person to make your request. Please be sure to take all supporting documentation with you.

thank you. i checked it out. it is only for I-129 not I-129f filings. my lawyer said it woulld get pushed faster. I guess he was just giving me false hope.

You can call the service center and they will give you a number to call if you are in the serviCe. Your application will be faster.

YES YOU CAN! My fiance is also in Brazil and I just had her papers expidited. Wish I had someone to help me out with this earlier.

I called the USCIS number that is on your NAO1 paper, told them I'm deployed she took some information. A few days later they sent me an email saying they needed a statement from me and either my deployment orders or a statement from my commanding officer.

Faxed that to them and the next day I had my NAO2.

Good luck!

Why should you get processed any quicker being in the Forces when you're not even in the country? Slightly irritating that everyone else has to wait in turn for their approval and Forces personnel can bypass the system?????

And before everyone jumps on me think about it, there are many other professions that are "doing good" for the country" like nurses, police officers etc etc do they qualify for expedited approval too??

K1 129 days to approval

K1 179 days to interview

EAD 45 days to approval

AP 45 days to approval

AOS 69 days to approval

probably because there is a greater risk for the military when deployed to a war zone. personally i don't see anything wrong with them getting expedited

This is irrelevant information for I-129 filings for worker visas.

Active duty military facing imminent deployment can have their fiance(e) visa process expedited. Your Company or Brigade Command should have information about this.

Well, I want to thank everyone who gave me answers to my to my question. Well, you sure are right.....there are many other professions that are "doing good" for the country. And YES, maybe they should be considered too for exedited approval. Thank you for letting me see it from you angle. We (vj's) are on this site to give each other advice and support. We are just trying to get our loved ones closer to us. We search for answers to questions. We have no time for opinions that don't reflect the mission of this website. I sure don't. I'm to busy making sure the Marine to the right and left of me get home to see his family.

i've been in each headquarters level of that list and it's highly unlikely co, bn, or bde would have any idea what an expedited process is. any servicemember would and should be directed towards the jag office.

just a quick leap into this, as i don't know all the particulars of meeting the requirements for expediating. I do know if for example he were being deployed to Iraq or Afghanistan he could have it expediated. Think of how hard it would be to deal with all the paperwork when u are in a war zone with a mailing address that takes weeks to get mail if you get it at all, trying to keep papers neat and clean in a tent, making copies and sending in evidence when u aren't even at home, and all the other hardships. It would be near impossible.

Or if you finally get your approval one week before you are supposed to move to another country? I mean you have to marry in the us but now u are in Germany? What are you going to do, take leave right after u arrive, come back her to pick up your fiancee, live at a relatives home for a week while u get married, then u have to get all her paperwork done before she can follow you to the other country.

Trust me...from being a military member and a military wife it is enough of a pain moving without the headaches of immigration, AOS, and AP all being added to it.

Couldn't agree more, Charles.

Good luck OP. Thank you for putting your life in danger to serve our Country! I hope you get your expedite! ;)
