Thanks for your replies, Bev and Scott :) I lurked for quite a while before I started posting, and I only remember one or two cases in the UK forum, and both were men orginally from countries where AP is relatively common. Now there's three of us (that I remember) and the others are both men, one an Indian citizen.

I was just thinking, there was a week or so back in April when quite a few VJers got out of AP and their visas in hand - we could do with another one of those around now :lol:

Update time: I e-mailed the Embassy yesterday as they said to e-mail them in 2 weeks. I pleaded and begged and they gave me some info that has calmed me---here is their responed.

"Thank you for your email.

Unfortunately, we may not disclose to you the process, but the process has to be complete before the final adjudication is done. The process is being carried out by three different offices and agencies in Washington hence the delay."

we FINALLY got a reply to the Senator's office from the Consulate!!!

Thank you for your inquiry on behalf of your constituent Ms. Monica XXXXXXXX regarding her fiancé’s I-129F petition. Mr. XXXXXX’s visa has not been denied. His case was returned to the Department of Homeland Security's Bureau of Citizenship and Immigration Services (USCIS) on June 14, 2010 for further review. Due to the personal nature of the information, the file was sent via registered diplomatic pouch (Reg # XXXXXXX).

Because of the issues you and others before you have raised, I instructed all adjudicating officers several months ago to extend the validity of any returned K-1 petitions for the maximum period allowable by regulation, so that the interested parties would have an opportunity to respond to any issues of concern in the return memorandum.

The Bureau of Citizenship and Immigration Services should be contacting your constituent to discuss the return of the petition to their office. However, if she wishes to seek information on the status of the case, she should contact the USCIS National Customer Service Center at 1-800-375-5283. She is advised to wait a few weeks before contacting USCIS to allow them to receive and review the file.

I hope the above information will be of use to constituent. Please do not hesitate to contact me if I can be of further assistance.

If anyone can give me their ideas of what this means I would greatly appreciate it. My fiance recieved a Refusal Worksheet with 221(g) checked at his 2nd interview. So I my question is....what are the odds (if any) of being reaffirmed?? Is CSC even allowing this as an option anymore, or r they still just letting them expire?? Trying to figure out if we should just wait & see what happens, refile the K1, or get married & do the CR1. Any advice would be great. :help:

Well Im so sorry to hear about what you had went through .My thoughts to you is cancel the K1 visa and get married and apply for CR1.It might take so long time till you will hear from USCIS .And i guess they will let it til its expire .

Most of this year CSC has been allowing denied K petitions to expire/die when returned to the CSC... they allow you to reapply and at that time provide a NOID.. this includes an explanation of the denial of the previous application and requires the petitioner to submit a response to the previous denial... after USCIS gets the response.. they review the case here in the states and if they then approve the case, the previous issue is assumed to have been overcome and the second round should be much smoother...

There are some issues with this...

1. They require new fees to be paid... new petition, interview police cert medical etc..

2. As the govt response to you said they should allow rebuttal for this intitial petition....

You can file the new petition now as long as you have met the requirement of having met in person within the past 2 years... I would prepare a new petition.. include a letter explaining that the first was denied.. how the issue has been addressed in the new petition and that you want a waiver to allow the new petition to be processed... I know it may hurt to pay the extra fees.. but IMO it allows you to decide when to start the process.. rather than waiting and hoping that they allow the petition to be rebutted... (not common now at CSC)...

Dont let this get you down.. look at it as a been there done that thing and now you know what to expect this time and what issues they had.... the good thing is that it was a 221g and not a 212... they are just saying that he was uneligible for the visa for some reason.. you should now know or will know when you refile what the reason was and how to resolve it before the next interview... it will likely take a minimum of 6 months to get another interview.. but as others here know from waiting for rebuttals to get done.. its potentially faster doing a refile... .

at least you dont have to sit and wait for additional months or even a year or more for them to tell you the same thing they said now... it may not be the response you wanted, but its not a 212 which would have made it more difficult...

getting married and filing a CR1 does not make it any easier IMO... the issue for denial is the same from last time regardless of which visa is applied for this time... Look at his 221g letter to see if it provides any insight into the reason for denial.. he will likely get a letter in the mail soon explaining the denial and that it has been returned..

<keeping fingers crossed> I am going to take a little nap right now so I can wake up at 3am to call the Embassy... I had read somewhere that they update on Tues and Fri... I am not sure if this is correct but I figure what the heck... I am learning Hindi so atleast I will be able to practice on someone fresh tonight < :rofl: > unless they hang up on me, I am not going to get off the phone until I know if we are under internal processing or if it is being reviewed in Washington... :thumbs: I dont know why it is driving me crazy to know... but it is... when Hubby called them Monday and she told him that she could see his case infront of her and that "they" are reviewing it... Which makes me think that this is in a internal process... is there even such thing as an internal processing when you are talking about AP? I mean where you arent stuck in limbo for months doing the 3 checks... and if there is such a thing... then... uuuuuugh... I am feeling so frustrated right now... I know I might whine alot but... damn.. I almost wish they wouldnt tell me everytime I talk to them to call back next week, because it is giving me this false high that I could have have my Hubby's visa in a week and then every week that I call I have a crash.... some say.. well then dont call... :devil: and then I want to stab those ppl with my grooming shears... <JK> but seriously... how when this whole process has consumed me for the last 9 months can I just sit idely by and not call them... espeacialy when they so polietly ask me to call them back the next week :whistle:
