Hi All

This is probably a stupid question, but we want to get things right ...

I am applying for my UK divorce in 9 days time (wooo hooo!) It will take approximately 2 months for me to get my final decree.

We are hoping to send off the I-129F application as soon as I can get a copy of my decree sent to my fiance in the USA. Will the lack of time between my divorce being granted and the time my fiance files be a problem for us?

I've waited two years for my divorce and we really don't want to hang around ...

No :no: this wont pose a problem, many people lived in separation for some time and met their fiancee, and filed shortly after divorce is final.

All that is required is that the couple are free to marry BEFORE filing I-129F.

Is now a US Citizen immigration completed Jan 12, 2012.

lol you have only to look at my timeline... ;)

I waited years for the final decree. I had the I129f packet with me the very moment I was able to pick it up ...made copies ..and mailed the petition of to Vermont within a couple hours.

Perhaps it would be scrutinized in certain higher fraud Consulates but you should be good to go. The law requires that you are both free to marry. You are.

Have a peaceful week ... I am counting the days until the 21st as my Steve is coming to visit me for a week and I'm going back to Iowa with him for another month - please pray that I get an Immigration officer that is having a GOOD day!!

I beleive that is why we are in AP right now...my husbands filed after we met (he was seperated for 3 years before we met) and his divorce had been final 3 months before we were married...been on AP now for 6 weeks :cry:

Oh my goodness! I was about to make almost the exact same post! My fiance first asked his ex-wife (or, well, current wife I guess! :crying: ) for a divorce 3 years ago!!! He signed all the papers and left them with the lawyer and moved to London. He talked to her on the phone after he moved to London and asked her if she had signed the papers, she said yes. *Insert mean word about her here!*

Only last September did we find out that she did not in fact ever sign the papers and actually told the lawyer that they had changed their minds...and since they had the same lawyer, the lawyer believed her! All this time he is still in London! So, after a 2 month process to make his father his power of attorney (a rather difficult task when you are in seperate countries apparently), his father signed the divorce decree in his name last November. However, in Brazil, after the signing of the papers there is a 12 month wait period to get the final divorce decree!!! 12 months!!!

I mean I understand why USCIS requires the final decree, really I do. However, I could provide them in a second an offical letter explaining that the divorce will be finallized by November 15th. And you know even if I filed today, his interview would not be before November 15th. It seems like they could say he was approved pending documentation of a final divorce decree...but I suppose that would be too good to be true.

Oh well....Counting down the days til November 15th I guess. :whistle:

Keep your fingers crossed. My finace's "now" ex-wife did the same thing. She made him think that she has signed the papers but then when he called the courthouse to make sure, they told him they haven't received anything... Nice huh? Can you say: Liar liar, pants on fire! hahahaha!!! :devil::devil::devil::devil:

But she really doesn't have a choice if he wants to get out of it.

Waiting is an ultimate pain... I know how you feel... Keep the faith! You'll get there!!!

Good morning:) My divorce was finalized in December and we filed our I129f in January...... Our interview is next month! As long as you have the proper paperwork it should be good. Good Luck!

Hey everyone!

Were going ahead and filling out the G325A and other paperwork to get it out of the way, and I have a question about what divorce date to put.

In Brazil you are technically divorced 13 months before your final divorce decree is ready. I guess in the USA we would call this a legal seperation...given that the parties can cancel the divorce at anytime in the 13 months.

So, on the 325 when it asks for place and date of termination, do you put the date that both parties signed the divorce certificate (for us in Oct 2007) or do you put the date on the final diroce decree (Nov 2008)??

My bf has his final orders tomorrow!! I'm so excited and since u posted that question I just tought to share my happyness with all of you and tell u I understand very well what u're going trought! It was a tought divorce but we made it ...so stay strong and be patience..it will be worth it!
