Hi everyone.

I got married in february but I don't know if it's gonna work out. I miss my homecountry too much and I think I want to go back. The application is on hold right now cause I have't sent in the initial evidence yet. Is there any way of cancelling the application without having my case look bad in case I would like to come back in the future?

that is pretty sad you dont want to stay married and all the work put into gettng this far.

not sure but i think when you cancel the process you either have to wait 5 yrs before starting over or you

loose it all and cant start the process again EVER... call USCIS

USCIS is not going to give you advice on what you should/shouldn't do in a particular situation. Even if they did, it's well known that the operators who answer the phones make mistakes in the advice they give.

To the OP: it really depends where you are in the process as well as what type of visa you used upon entry into the US.

I would think if you get a divorce, cancel your application (for AOS I assume) correctly, should not be held against you if you want to apply for another visa in the future.

If you only need time to re-think but want to stay married, I think you can apply for a CR-1 visa if you decide you want to come back.

assuming homesickness is the only problem,why not wait till you receive your AP? But not be mean, but if you, missing your home is enough for you to divorce your spouse than you obviously dont love your spouse anyway.

I'm going to respond with tough love: You're being very selfish. Home sickness is normal and it's part of growing up in life. Think about your spouse's feelings. You can probably get your AP in 12 weeks after you send in the papers.

Wow, I'm sorry you're feeling the way you're feeling.We all feel homesick at some point...The first few months can be the worst.

I would agree with a few of the others,...get your AP..go home for a bit and see how you feel. I was missing home terribly.....but you get past it..at least most of us do.

I would hate to see you make a decision you might very well regret in the very near future.

I don't want to come down on you...its your life..

I would give it more time before you decide..home will always be there
