i am just about to send all of my paperwork off to uscis and i realized that i can't find the letter of intent to marry from my fiance. Should i wait until i get his to send in everything or can i just send it later on its own? i'm anxious to get it mailed and wasn't sure if we would be denied without the letter. Also does it absolutely have to be notarized?

I would wait until you have it to send the packet. Chances if it being put into your folder at USCIS are slim to none. You also don't want to risk getting an RFE.

Request for Evidence. It's what you get if you forgot to dot or i's and cross your t's. If you do not give sufficient primary evidence or basic documents requested, you will get one. If you do not give enough secondary documentation (i.e. photos, letters, e-mails), you may get one. You obviously don't want one because it delays your case from being approved, so it's better to wait and have everything ready, notarized (what needs to be) and sent together after being checked several times.

An original letter of intent is required from both parties so I guess in the eyes of the USCIS it is a faily important document. You however will not be initially denied if one is missing as you will have a opportunity to "cure" any missing evidence later during the adjudication process as the USCIS will issue a request for evidence (RFE). If you fail to respond to the RFE or you are unable to adequately provide the needed added evidence they want then your petition will be denied.

PS. It DOES NOT have to be notarized.

This is an important letter and is part of the petition. Don't mail in your petition until you have it or you will

delay your whole process.

i'm thinking she would have asked for it if it was necessary... She's been handling K1's for years...

theres nothing to worry! our case was filed by lawyer's service and did not include letter of intent to marry in our petition. we were approved March 19th! :)
