ITS just wrong for 2 reasons 1. they do not tell us we need to do it that way and more importantly 2. Is there someome in our goverment who makes decisions as to who is safe to allow into our country that actually thinks a dtgital date is more Prima Ficia then printing on the back??? That is really scarey and shows why 9/11 happened people with a really wrong idea of what is and is not reality

that's ridiculous. Not everyone has a digital camera, (me), and if you are including pictures from the past, you weren't necessarily thinking then ... hey, I'd better put dates on these when I print them, in case I ever lose my mind enough to go through the K-1 process.

That is just what I was thinking! Some of our photos were taken with my old camera which printed the date. Our more recent photos were taken with my new digital camera--but I hadn't read the booklet when the pictures were taken, so the date didn't get printed on the photos. Besides, like you said, at the time we were not thinking about requirements for K-1.

Our photos were taken on a very old 35mm camera. By the time I got back from my visit to see my Fiancee, I had no clue on what date did I take this picture on or that picture on. #######, I should've logged everyday I was there in some sort of jounal.

Hmmmm.... I didn't have dates or anything on our pictures. Just submitted about 15 pics with no explanation at all. I did have a bunch of other evidence, passport stamps and ticket stubs from 5 trips. I hope this doesn't get me a RFE. None of the pics we have are dated.

One of the pics that I sent is of us sitting in front of a Christmas tree. That pretty much dates that one unless they think we set one up just to stage it.

I wrote our names, the date, city and country on the back with a permanent marker. I could not even remember exact days so i just wrote the month and year. Someone at the service center must have been having a bad day. Sorry for your RFE.

Let's not all get freaked out by this people. Firstly, there have been many people approved without any photos at all!

Secondly, whenever you call these service centers you are more than likely talking to someone that has little or no idea what they're talking about. If they did they wouldn't be answering the phones!

My take on the OP in this thread is that he submitted a petition that had weak primary evidence and was subsequently RFE'd for better evidence, or supplemetary evidence to support what he has already sent in. Apparently someone wasn't convinced.

Here's something that I wrote awhile back but still applies now. Knowledge is power!

Just remember that if you have very strong primary documentary evidence photos are unecessary, and not everyone has one to submit anyway.......

I have found an inordinate number of RFE's that were issued due to the fact that the Petitioner submitted evidence that was:

1) wholly reliant on photo evidence, or

2) had submitted photos to supplement soft documentary primary evidence and were RFE'd to either supply digitally dated photos or supply more primary evidence

Photos are secondary evidence and can be faked. The USCIS knows this. Documetary proof (primary evidence)is the prefferred form of evidence over secondary evidence such as photos in adjudicating a case and is defined as such in USCIS adjudicators field manual.

Primary evidence:

-Exit/entry visa stamps, airline ticket boarding passes, hotel receipts, CC statements with charges in the place/country in question, joint leases, apartment reciepts, utility bills, are irrifutable as primary evidence.

Secondary evidence:

-Photos may be used to supplement weak primary evidence but are completely uneccessary if the primary evidence can stand alone on its own merits.

What I have concluded from my searches is this:

-Those that supplied no photos and had adequate primary proof were approved.

-Those that supplied photos only, or varying amounts of photos in conjunction with other secondary documention recieved an RFE.

In all my searches of this forum never did I find a thread whereby the Petitioner was RFE's for an absense of photos.

I know of at least 4 users, only 1 of which I can still identify, that submitted no photos and were subsequently approved.

I will provide some links to threads whereby the Petitioner recieved an RFE because they relied heavily on photo evidence and not on primary documentary proof.

WOW I just took a piece of heavy duty paper and taped the pictures under each other, layered them and made kinda like a flip chart, typed the dates, location and people in the pictures on a small piece of paper and taped it to the botton of each picture to make tabs, so they could just flip through the pictures. (does that mack since?)

We got approved no problems and no date stamp on the pictures.

Our pics didn't have digital dates on them either.

What was the resolution for the lack of digital dates?

Are they saying we have to physically go to the country of our finace(e) and retake pictures?

We were forwarded from TSC to CSC with a NOA1 date of March 7 2006.

Can you share with us at least what your NOA1 date is?

We'd like to know if you were before us or after us; I assume you were before March 7 2006.

Thanks for helping us understand what's going on with your case.

I submitted copies of boarding passes, passport pages with stamps, visa therein, registration in Moscow, along with pics (names, place, date on back), copies of emails, other evidences of ongoing relationship and meeting.

It is possible the USCIS, based on many unsavory things that are in the Government's eye, has implemented very recently guidelines to RFE if EVERYTHING is not exactly like they want it?

And there is not precise "how to" so how do those of us having NOA1s get this resolved?

As a newbie, I have already noticed inconsistencies with USCIS with other items. The first time I called I asked whether anything needed to be notarized (before posting here)... and they transfered me to a supervisor who said that I needed the letters of intent to marry notraized. I then posted something here and everyone said I don't need it notarized... I called USCIS one more time and they said I do not need anything notraizd (even after mentioning that I spoke to a supervisor the first time).

Perhaps some representatives error on the side of telling everyone they need more than required if they don't know and if a question is asked a certain way. Anyhow, it seems like the advise is not to worry about it... which sounds good to me as I already printed my photos and did not have a date on them :-)
