I'm so sorry....I honestly can't imagine what you're going through and it must be so hard. I know this is a stupid question and I'm sure the answer is yes, but you did take evidence of your relationship right? I can't believe they would deny you especially after you say you lived together for such a long time.

We had all kinds of evidence: phone/chat logs (going back almost 2 years) a joint leas agreement from when we lived together in his home country for nearly 6 months, wedding photos, photos of our time together, plane tickets, hotel stay receipts together. What else, in God's name, could they possibly want?

What???!!! How on earth could they deny you? I remember us both waiting for our NOA2 because we had almost the same scan date. I can't believe you waited all this time and did everything right only to be denied. That makes me furious. I would most definitely appeal the decision. Search for CR1 visa appeals on Visa Journey and maybe you can find someone else who did it and was successful. Again, I'm so sorry.

Yeah, I'm pretty outraged but I'm also not finding any reliable information about appeals. It sounds like it can take a year for them to review your appeal which is about how long it takes to file a new I-130. Also, the appeal doesn't allow you to submit more information it just makes someone else review the same file you've already submitted. What I'm interested to know is, what on earth could we have done differently. If we file an appeal or even if we were to re-file a I-130 we are going to have the exact same kinds of evidence of a relationship that we have now....I'm at a loss. If anyone has any suggestions I'd be very appreciative. I can't accept this but I don't know what to do next.

Do you think it would be worth it to contact an immigration lawyer in your area to find out what your options are? Maybe find one with a free consultation and explain your situation to see if they think they might be able to help?

I think that's the best idea I've heard so far. It's just a matter of finding a good one who has either low-cost or free consultations.

Exactly, then they can at least tell you what they think the best shot you have is and you can go from there. Definitely look up online reviews first before choosing one.

I've couple questions though so bear with me please. Did you have any red flags in the relationship? Age difference or religion? And I read you filed for cr1 from abroad, does that make the process of handling the case any different? 

Why were you denied a k1 in the first place and are you allowed to reapply for either of the visas?!

Timeline

We just got a case closed!!! 10/25/2017

We were in supervisor review and they said we still didn't have the papers. My husband spoke to them again and said we were told to send them and they would be included in the supervisor review. Also that it seemed a little silly since the papers were there to not just review them all together and save themselves some time. Well, they did just that. It still took almost 7 weeks but done!!

Now we wait for interview date! They just need to bring financial evidence.

Mine is almost a similar situation so am interested in response to your case.

 

For our case we have 2014/2015 transcripts well above the guidelines, 2016 was at or slightly above. 2016 wife was homemaker so no W2 but now back to work last 2 months. Current Y-T-D is well above guidelines. Wondering if this will be an issue if we provide employment letters and pay-stubs. We have no one to file as joint sponsor currently.

Hello all,

 

could you please help me a bit with my visa status? In may I got my first checklist where NVC wans my passort bio page and AOS. We submit documents on June 09 and on 08 August I got second checklist due to problems with AOS ( does not meet poverty guidelines) and there was written to bring new AOS to visa interview. 

Now my visa status is "AT NVC", does it mean that case is completed and I must wait when interview will be scheduled or what ?
