Visa rejected under 221g for administrative processing. Consular advised to wait for few days

I think it was a tad unfair to bring Britain in this, yes it was unfair what happened to India and yes it has taken time for the country to become what it is today and yes I understand you love your country but please lets just concentrate on your AP and the rest of your life with your beautiful fiancee. You have many positive comments and suggestions on this thread and I'm sure that your fiancee getting in touch with her local MP or Senator, sorry not actually reading that particular post is definitely going to be in your favour.  I don't think you will be here by the date you want to be, but never say never.  Any way I have said all I want to say on this particular thread.  I wish you both good luck and much happiness for the future.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

A couple of things OP.. Not sure how bringing Britain's past into this solves your issues. Plenty of corrupt politicians in India too, no?

And why not consider having your fiance and her kids move to India if you're earning good.. she'll do anything for love, no?

Eh, I dunno. Normally if the woman's a USC with kids, they won't move. It's almost never the reasonable thing to do, no matter how much you love someone.

There's the "I'll do anything for love" and then there's the reality of actually doing anything for love. Most people won't if it shakes up their world too much.


With all that said, all the OP can do is wait and see what happens. Also note, that our opinions don't really matter. The officer doing the interviews opinion matters, and as bad as it sounds, proof of love is greater than love itself when it comes to immigration. And if your love is abnormal, it's just another hurdle.

While it may feel weird, sometimes you just need to do things simply to please USCIS if you TRULY want to be in the US with your loved one. Like visit more often, visit families. what ever.


While you may think it means something to facetime with someone or talk online, it doesn't mean anything. Physical contact will ALWAYS trump seeing someone on a screen.

Friends can talk to each other over seas on computers, but people who are dating tend to make more of an effort to see each other in person and have that physical contact. Most friends aren't willing to use their vacation time or money to go visit someone on an AT LEAST yearly basis across the world.  If you brush off the necessity of actual physical presence when dating someone, then almost no one will take your relationship as being legitimate.

Mere suggestion. 

But something to look into as an alternative if a visa is denied. No law that says must move to the US.

Oh no I agree 100%. I guess I was just chiming in on that idea, as we have so many people on VJ that run into this issue and then end up going "Oh well no they won't move here, what else can I do?", or end up so incredibly adamant that they NEED to be in the US and the US only. ESPECIALLY with USC women with children, I think I've only seen a few cases of them picking up their kids life for the guy they've only spent 2 visits with. Most people would call that insanity and selfish. /shrug

This is a couple that will marry, not a hook up. Somebody has to move and it would be silly to exclude all options.

Well if that's the case then I wish them the best of luck. I just hope they're prepared to do everything it takes to move a whole family if needed. It's hard stuff.

Dear all, thanks for your advises and I appreciate your comments.

 

When I met her first, the first thing I asked her to move to India as I live in Shimla (summer capital of Britishers) in Himalaya region and it is a beautiful place. Though she like this place too but she can't leave her children until they grow and become independent. So we decided to move to USA and of everything will go smooth we will spend time in India as much as we can.

 

I didn't told these things because it really doesn't matter to him. He asked me about my planning to have kids with her, and I said yes we have planned to have 1 kid of us as well. He was like, will she be able to give birth at this age, this was too rude. I told her she is perfect and as per doctor she can give birth to healthy child upto next 5 yrs and it is a truth. I should have asked for doctor's certificate from my fiancée of I would have any idea. My grandmother gave birth to my dad when she was 46 yrs old. I can't believe that are running out of time and these people are taking time in administrative processing which is a never ending process. They put my case for name check in last time as well, but case expired after 4 months and USCIS record kept telling that case is still under name check till one and half year. 

 

Consular saw her in pics how healthy and beautiful she is. When we applied for Visa she was 37 and more healthier to give birth to baby. If it a genuine concern for consular about baby planning, why didn't he gave Visa 3 yrs earlier. 

 

I'm planning to marry her if they deny, but a consular have same opinion then what is the assurance a consular will approve our Visa. After waiting another year, what we will hear a denial again.

 

I agree that India is on top of their fraud cases but these cases were of same race or religion. I came to know about it later on these forums, people invite their relatives or friends on the basis of fake marriage and they may do it for money a well. But I never heard any interracial cases of fraud as no independent women earning good on USA will do it for money. No one wait for 4 years if love is fake. I can wait for her forever and if I will have to wait, I will wait.

yes, people will wait 10+years if fake.. trust me. they will wait because they know a greencard is coming and if they leave you andmeet soemone else the case is 10000x harder. 

 

their is a case of a woman on here who did a waiver and everything for her husband.. thourhght she was in love! and once he gotthe GC he left. as long as you are waiting in america and trying to get him here, he will wait as well.. move to India and give up on the process and see what happens

I told you, you can't see everyone with same view. Go to her facebook profile and see how beautiful and perfect she is. I have seen cases where the age difference was 24 yrs and mine is just 6 yrs.
