Immignt getting rejected in LAX

Timeline

Hello, I just submitted my K1 visa for my fiance in Croatia and then I see the a Croatian lady was deported back to Paris on a tourist visa....and I'm reading they are making people surrender their visas....should I be worried...I mean if they are gonna do that then whats the point of even doing this and taking our money like we can get a visa? I mean other than the obvious of getting the money....

There are legitimate reasons for people being rejected or having their visas stripped. They are either trying to violate the terms of the visa, are found ineligible for entry to the US, lied to immigrations, were found to possibly be trying to immigrate using a tourist visa.. there are a lot of various reasons.

 

The whole point of a K-1, which is a nonimmigrant visa but with dual intent, is to immigrate to the US. It is rare that I am aware of that a K-1 visa holder is turned away at a POE, unless again they are trying to bring something into the US perhaps they shouldn't or are acting super sketchy/suspicious during the entry process; but again rare these days.

 

So this "fear" or "worry" you have, should just take a deep breathe and relax.

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

It's irrelevant. There is currently no directive against Croatia or the K-1 Visa program.

This is true but just the end of jan if you read the news the held a bunch of people coming  on various visas and even made a Croatian lady coming from paris on a tourist visa return to paris...and croatia isnt on the list....did you see then news about the protest and attorneys trying to help at lax ...how can that be irrelevant? At this point they are overstepping their rights to hold people people and make them surrender their visas...

I really hope that is all true....cause im sure the people eho are being detained and forced to surrender their visas and sent home are wondering why its happening and the truth is its trump causing this issues......but I will hope that by the time he flies down all this ridiculous nonsense is over...

Yes, it's possible that either a new EO is signed that affects you somehow, or that somebody goes against the norm and is otherwise gives you as hard time when entering on a K-1. However, trying to guess what will or won't happen based on worries is not a practical approach to the issue. There's nothing currently affecting K-1 visas as a class, or anybody from Croatia coming through legal means with a proper immigrant-intent-permitted visa.

 

Take a few breaths and relax. The sky is not falling. You'll be fine.

If you're worried about LAX then perhaps you could have your fiancé fly into another airport and then catch a connecting flight to LAX? Domestic flyers don't encounter immigration officers.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.
