Hi guys,

my company is flying me to TX for a business trip for 3 days.

Will I have a problem while my ROC is pending and my green card expired?

I have the NOA extension letter, a valid WA Driver's license and a passport.

Should not be any problem at all. Likely won't get asked for your passport on domestic flight. For now, your WA DL will likely suffice. For international travel, you should also include your expired GC.

Have a pleasant business trip.

Not sure where in Texas you're flying into. In the very remote event that CBP agents are hanging around the TSA area, carry your extension letter. There's at least a 99.44% chance that you won't need it.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I traveled while ROC pending - both domestically and by land to Canada.

I brought the extension letter and had no problems crossing to/from Canada. As for domestic flights they didn't even ask or care.

CR1 / CR2 Visa:

(Day 1) 12/16/11: I-130 Application sent

(Day 283) 09/24/12: Interview at US Consulate – Approved!

(Day 287) 09/28/12: Visa Received & Immediately entered US using Visa

(Day 290) 10/01/12: Social Security Card sent automatically

Removal of Conditions CR1 / CR2
(Day 1) 07/28/14: Application sent.
(Day 135) 12/10/14: ROC Approved!
(Day 143) 12/18/14: 10 year GC received (IR1 / IR2)

Naturalization:
(Day 1) 06/30/15: Application sent.
(Day 210) 01/26/16: Interview and Oath Ceremony. DONE!

***Son and I became US Citizens 01/26/16***

(Day 1) 01/27/16: Applied for my U.S. Passport
(Day 14) 02/10/16: Passport Book & Cert of Naturalization received

(Day 23) 02/19/16: Case received at local office

(Day 88) 04/23/16: In line for oath scheduling *Called USCIS to inquire about why there is an oath required for a child under 14. They sent a service request to the field office.

(Day 95) 04/30/16: Received letter from field office to say no oath necessary and that they would mail the certificate.
(Day 106) 05/11/16: Cert of Citizenship received by registered mail (they never sent tracking. case status was never updated either)

Just one caveat and, I don't know if this has been ruled on yet, but some states, including Washington State, are NOT Real ID compliant and may require alternate ID for domestic travel. This would also include US citizens from those states. They say passport but your expired GC and ROC letter should be fine. You could probably use an unexpired foreign passport as well, as long as the name matches the ticket. In any event, I would verify this before flying so there are no surprises when you get to the airport.

(Edit: Well, it looks like it wouldn't take effect until April, at the earliest, no matter how they rule. But, something to potentially keep in mind for the future.)

Honestly, it looks like the driver's license will be fine, at least until April. Your expired GC and ROC letter should also be accepted as valid identification for air travel. I would still check with the airport/airline before the flight to verify this and, if you must use your passport, the marriage license would probably be necessary to validate the name change.

But, I think you'll be OK with your DL for now!! :)

Even better! You are definitely OK with your Wash. driver's license! No GC/ROC letter, passport will be necessary, but it is probably wise to have the GC/ROC letter with you for other reasons as TBoneTX mentioned.

The TSA/Dept of Homeland Security issued a ruling that no state driver's licenses would be refused prior to Jan. 2018. They clarified the rules in mid-January, after the previous article I posted came out.
