Not Legally Divorced Yet K1 Visa Meeting in Person Question

Hello, I have met my fiance 3 times already. I have been separated and living at my own place for over a year. My divorce has taken some time, but it should be final in the next month or so. In the year I have been living alone I met my now fiance and visited her 3 times. I separated in October last year and met my fiance in January.

I know I will have to submit all paperwork once I have proof of divorce, but my question is:

Will I have to visit her again after the divorce? Will me meeting her prior to being divorced not count as being in a relationship due to my legal status?

My soon to be ex is in a relationship and I am in a relationship now too.

As far as I know, there are no issues with you having been with your fiancee before your divorce was final. As long as you have the final decree when you file the petition indicating you are free to marry, then you are meeting the petition requirements.

Depending on how the Belarus consulate handles things, your fiancee might be asked about it during her interview.

No you are fine; the meeting within 2 years requirement is separate from the free to marry requirement.

It's not a problem. My divorce took until May of this year and we met 3 times before then. As long as you're divorced when you file, it doesn't matter.

No problem. Just get your divorce and a certified copy of the decree in hand before you file the I-129f. You will have to put it in with your I-129f submission. And remember that courts sometimes take a few months to issue the paper divorce decree after the judge grants it, so plan accordingly.

I really hope I get the decree soon after. I don't need to add extra time to the K1 process. It is lengthy as it is.

i got same problem here.. me and my fiance met and got in a relationship before he and his ex-wife got divorced but they're already separated. Is it a red flag? he filed our I129F 10 months after the divorce decree was released =)

No you only need to he legally free to marry when you file the petition not when you meet.

So after much, much waiting I finally divorced and submitted the i 129 F this last Friday. No the waiting begins I have seen my fiance 4 times and there is plenty of evidence of our ongoing R, so I hope there are no issues.
