    PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
    When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
     
    Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

    Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
    I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

    Wrong USCIS application form filed by my lawyer!
    Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

    Seeking advice for Thai/US couple - What US visa path to take?
    My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

    Hello,

    i hope someone can help me with CSPA. i tried using sites with CSPA calculator but they all said different answers. i am 25 yrs old now, f2a category, unmarried and petitioner (mother) is still LPR. it took awhile because NVC moved me to f2b and i am unable to submit documents in CEAC. in 2023, i received an email from NVC that they moved me back to f2a because of CSPA

    APPROVAL DATE: 3/24/2020

    DS 260 : 1/25/2021

    IV PAID : 1/4/2021

    I'm confused about the delivery\appointment for the CR1 visa

    Hi there,

    My wife and I have just submitted the (CR1 visa) civil documents to the CEAC website. We are doing this in Singapore. We then went to the NVC website that shows all the steps. We click on Step 10 (Interview Preparation). On step 1 to "Schedule and Complete the Medical Examination", there is a link to the list of US embassies and we go to the SG embassy. The first step there says to "Register". See below:

    Please follow the steps below before your immigrant visa interview at the U.S. Embassy in Singapore.

    Step 1: Register online

    Before your interview, you must register online to either designate the office where you wish to collect your issued visa packet or to enter a delivery address. Registration is free. Click the Register link below to register.

    The register link sends us to ustraveldocs.com. We registered for an account and we successfully get to the step where it asks were we want the visa delivered. We pick an option and continue. It then asks for the NVC Case #. We enter the case # and get the following message:

    The Case Number entered is invalid. Please confirm your Case Number and re-enter it.

    We definitely typed it correctly. Are we doing this correctly? Maybe we have to wait until the civil documents are processed?

    Officer approved the visa at the interview but now it says refused- Almaty Consulate

    Hi there,

    My fianc had his K1 visa interview last Thursday, and the officer asked basic questions. Then, she said, 'Congratulations, your visa is approved, handed him a paper with instructions on how to collect his passport, and said he should receive it in 3-5 days. The status changed to 'refused' on Tuesday, and they contacted us on Wednesday, stating that the case is in ongoing administrative processing, and requested copies of his old passports -he holds two citizenships-, which he had not used since 2011. So we did, now I am concerned about why they asked for that, and how long does this usually take?

    Note: the officer asked to see the requested passport in the interview, so he told her it had expired, but here u go. She saw it and gave it back.

    Hi all

    I recently discovered this forum and have been reading avidly all of the great advice and guides.

    I am looking for some advice, based on the far greater knowledge of forum users here and perhaps past experiences, on the best and quickest way to proceed in my circumstances.

    Circumstances:

    • My long term partner (US Citizen) and I (UK Citizen) have been together 7 years, during which time we have each visited UK and US, respectively multiple times per year. In my case, on an ESTA.
    • We both have good jobs, plenty of savings and own houses etc
    • I intend to relocate and work in the US on a permanent basis as soon as possible.
    • I am exploring options for relocated through work with my current employer and obtaining visa sponsorship that way, but that is proving slow and frustrating.
    • Due to a recent change in circumstances (partner is now pregnant and this will be our first child) I am planning to take a career break and spend as much time as possible (ideally the entire term of the pregnancy and child birth) in the US to support my partner.
    • In an ideal world we would legally marry and got the CR-1 route, however, the 12-15 month processing time is clearly not going to work given timeline
    • K-1 visa appears to be the more likely and slightly quicker option, but again, 6-12 month lead time would not work either - even with potential short visits to US whilst the K-1 application is pending.
    • My current thinking is applying simultaneously for a B-2 and K-1 visa is my best bet for getting to US in the short term and being able to stay for 6 months (+ possible extension?). However, having read other forum posts it appears that the success rate on the B-2 applications is quite low?
    • Other option I can see is to travel on ESTA with the intent to visit/support during pregnancy, get married and then apply for change in status, work authorisation and advance parole etc. This feels super risky though.

    Need Help Filing the Right Motion After Humanitarian Parole Denial

    Hello everyone,

    I m seeking advice on how to properly file the correct motion after a Humanitarian Parole application submitted by my wife was denied by USCIS.

    The reason for the denial was that they felt there was no urgent humanitarian reason or significant public benefit to justify granting parole at this time.

    My wife is a Ukrainian national who fled the war and is currently living in the United States with a pending asylum application. She filed the parole request to help us reunite, as I am currently living in Italy under refugee protection.

    We are now preparing to respond but need help understanding the right next step. Should we file a Motion to Reopen or a Motion to Reconsider?

    If anyone here has experience with similar cases or can guide us on how to proceed including what kind of evidence could help show urgent humanitarian need we would truly appreciate your advice and support.
