How can I file i-601 waiver

Timeline

I petition my mother with i130 and it was approved she had interview in ciudad juarez Mexico. And recieved an blue paper to file a i601 waiver. Q: what will make my heat ship stronger my mother had 4 children in the US including me all citizens never had a bad record and I have a my smallest brother that is 12 years old he is going though a hard time with out my mother here in the US. Would that help here case.

Please any information will help

No only here children and my father that is a permanent resident. In the interview they told here I would take 3-5 months for the waiver that she has nothing negative in her record

Are they still married? (Your father & your mother.) if yes, than the answer to the previous question would be YES. She would have a LPR spouse.

you won't do the hardship letter, as children don't qualify, your LPR will have to do the hardship letter, he will have to prove why he needs your mother here, and why can't he move to Mexico to be with your mom

you opened two threads of the same thing

in the other thread you asked about qualifying relative, as per the instructions of the i601 which you can read, there are only a few qualifying relatives for the hardship letter

your mom fills out the i601 form, but it must be accompanied by a hardship letter. The qualifying relatives are USC or LPR spouses or USC or LPR parents

but not the other way around, USC or LPR children and siblings do not qualify for the hardship letter, or USC fiance

your mom was given the chance to file the waiver because she has a LPR spouse, if your dad wouldn't have been a resident, she would have to wait the 10 year ban in Mexico and once the ban was up, you could file for her again

then there is nothing you can do, she will have to wait the 10 year ban outside

she should never have left the country, especially having a young child, he might need to return to Mexico to be with her

because she will have to wait the 10 years, the officer made a mistake, maybe he got confused or something that he thought they were married

because she cannot file the waiver through you

you were asked if she had a USC or LPR spouse, your father isn't considered as spouse if they aren't legally married

Can't the parents marry first then the LPR father of OP/then-spouse of intending immigrant can write the hardship letter/be the qualifying relative?

How do they file taxes together if they are not married? Have they gotten married in Mexico?

if they married in Mexico, then your father would have to file an I130 and wait for it to be approved. Your mother would have another interview..HOWEVER. The visa is not available immediately. She would have to wait for a visa to become available. LPR is not the same as a USC. There are unlimited visas for spouses of USC. then after your mother gets her interview...then she could file the Waiver. Correct me if I'm wrong ...but it could be 3 years or so before a visa is available...If Donald Trump is elected President...expect some immigration changes. Also..the processing times are sure to change upon the new president taking office. You would be wasting your time and money filling a waiver at this point. The current approved I130 probably isn't worth anything.. You can't be the qualifying relative and your father can't unless they marry.

No, the petition would still be filed by the OP, and would be an Immediate Relative petition. The hardship would be hardship to the father.
