We have been petitioned almost 16 years ago by our uncle in New Jersey and then in the early 2015 our petition is approved by the USCIS and it says they will mail our approval notice. After the petition is approved I checked the Form I-130 Brother of a US Citizen Processing Times and it says November 7, 2011, when will be the next processing times of this case after 2011? And when did our approved petition will be mailed in our country?

Hi,

Terminology is important. Your uncle filed for his sibling. He can not file for a nephew. His sibling's children are included in the petition if they don't age out when visas becomes available.

Processing time for the I-130 is not when visas becomes available. You need to look at the Visa Bulletin to see which beneficiary is eligible for a visa. The current PD for a sibling in the PI is Oct. 1, 1992. It will probably be another 8 years before your parent's case reaches the next stage. You will hear nothing in the meantime.

My Father is petitioned by his brother way back in 2000, approved by 2015,and just like my uncle said we are part of the petition his brother is my father so I have right to accompany my father during the interview and as part of living in the United States? So my uncle, who is the petitioner is urged his brother and I as the nephew to accompany in the petition? No matter what I will join, just like as he promised!

Best of luck. I'm trying to help you learn, but you rather insist on your "right" rather than learn the law. Better hope you don't age out. A petition by your uncle for your father does it give you any right. You are only a potential derivative beneficiary who can age out. You don't have any right to anything.

Already told you that there will be no contact for the next 8 years. The petitioner has already been notified in 2015 that the I-130 was approved. USCIS does not notify the beneficiary about approving the I-139 and will only contact the beneficiary when the PD is close to being current.

How old are you now? The answer is if you are below 21 after 8 year or so, yes you can go with your father during the interview and migrate to US.This is not your right - please! Mind your tone, immigration to the United States should be understood as a privilege, not a right.

As mentioned, your waiting time is about 8 years or more if your priority date is in 2000. Start counting.

hi

your uncle cannot urge or promise you nothing. the petition is for your father as the main beneficiary. His wife will come, your mom, as long as they don't divorce

children are a different story, you haven't said how old are you. children can age out, be out of the petition, the older you are after 21, the less likely you may have the chance to come with them, or if you marry, you will be out of the petition

as said, there are still 8 or more years of waiting, so anything can happen in those years

Actually there are probably more than 8 years of waiting. The people at the front of the line today were petitioned in 1992. However right now that line is much longer than it was in 1992. If nothing changes there wait is probably much longer for you than for those that were petitioned in 1992. It could be another 20 years to wait. There isn't data that says how long your wait is, just how long people that are now getting an interview have waited. In areas that are severely over quota it is unlikely that child will not age out.

This will not be over quickly. You will not enjoy this.

Is there a chance for me even if I'm overages for my uncle's petition, just like my parents said I have a medical condition that needs to be attended so it is possible for my parents file me dependency in able for me to go in US?

Your parents can't bring you with them when they come. They would have to file for you after the arrive to the US. You will fall under F2B category so it will take about 7 - 10 years (or more).

If your condition needs their attention then you should look into one parent staying with you in your country until your visa is ready.

Is there any chance for my parents file for separate visa from the petition in able for me to join due to my medical conditions. It means is there an alternate things should my parents file for me in able to me to come with them if time comes. Sorry if I'm so questionable I'm just finding alternatives. Thank you

that's how immigration works, if you have a medical condition, as said, one parent can stay behind with you and the other parent comes and files for you

Under the current rules there is no chance that they will bring you with them not matter what medical conditions. They will think that your parents should opt not to immigrate if they have a child to care for, it is what good parent would do in the US mind. Changes in immigration rules could make it quicker or totally eliminate the ability to bring adult children. But no one can see the future.

This will not be over quickly. You will not enjoy this.

I don't see what the medical condition has to do with it? Why would your parents be leaving you for good if your medical condition is so severe that you need their round-the-clock care? Parenting their sick child should be their top priority. Looking for a new life in America should be their second.

Be prepared that you may never get there.
