Is K1 allowed to work without EAD?

I was just wondering if a K1 is allowed to work. Correct me if I'm wrong, but I read it somewhere that it says that in some POE's K1 are given EAD and some are not. So generally K1 are allowed to work. And what is the consequence if you work without EAD.

Its very uncommon to get the EAD stamp.. i'm not sure what the consequences of working without authorisstion are but im pretty sure it would make your AOS alot more of a trial than its really worth.. I have a feeling your employer would get into more trouble than you if you were caught, but it still wouldn't look good that your are already breaking the law soo after arrival.

You can volunteer your time, but cannot receive any "benefits" from doing so..

Good day..yes, I have also read about that..In some POE's they issue a temporary employment authorization that will also allow you to work until your K1 Visa expires(sp probably 90 days)..so far, here in VJ, no one has ever been granted that one i guess...so probably, lucky for those K1 visa holders who entered that was given the chance..as of me though, I'd rather apply for AOS soon if you really want to have an EAD as soon as possible..coz if ever, you will be given that temporary work permit at your POE but then you were not able to file for AOS whenever your visa expires, still your status for working will be illegal since that Temporary permit of just 90 days too!!...God is good..HE always provide..enjoy your loving moments with your sweety while waiting to apply for AOS...have a good day..God bless!!

By law, you are not allow to work, unless you got your I-94 stamp with work authorization by DHS. But then, considering that your I-94 will expires within 90 days, even if you got an authorized work stamp upon arrival in your POE, but in reality, can you find a job within 90 days? And potential employers will not want to take the risk to hire someone and have this employee work permit expires within 3 months, because if you continue to work when your I-94 (with work permitted stamp on it) expires, your employer is hiring you as an illegal by then. For now, you can still 'work', but without receiving any benefits that translate to money. Only when you get your EAD card on hand, then you will be eligible to work.

K1's are NOT allowed to work without an EAD. Working without an EAD would be VERY bad if you're caught. Extremely bad both for you and the employer. If you're not caught, well it's your conscience.

K1's haven't been given EAD stamps (from everything I've been told) for quite some time. If they DO get a stamp (some POE officers do it because they don't know) this stamp is STILL not giving your permission to work.. it doesn't actually do anything (someone posted about this a while ago and the full explanation).

Sorry, apply for AOS asap and you should get your card in about 2 months (usually less)

Hey all,

My POE was New York, and I did ask about the 'employment authorization' stamp, which only then did my officer stamp onto my I-94, but truthfully I don't think it's very useful unless you already have something lined up. but even then, it expires within 90 days, and there's so much else to do during that time period (getting married is the BIG one, applying for your AOS etc).

Also generally employers and job applications mostly request that you are a permanent resident and can verify this at an interview. Which at that point we aren't...

Also having a period of 'limbo' between employment authorozation for 90 days, and applying for permanent residence, will not actually make us attractive prospects for employers anyway. Employers want guarantees, that's their priority :)

So from my personal experience, the stamp hasn't been useful (although I did think it was important when I first arrived), and if you feel you can do some work for money during the 90-day period, then by all means ask about it at point of entry.

If you can. Do a CR-1 and you'll get your GC and be able to work with a month or so of arrival.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

NO NO NO! Please read the previous discussion (in which you also said this) on the Work Authorisation Stamp and K1's, it is ILLEGAL for a K1 to work without an EAD (received by filing an I-765). The Please read the I-9 paperwork which explains what is required to be able to work, and the stamp you're talking about ISN'T a valid one.

Again IT IS ILLEGAL FOR A K1 TO WORK WITHOUT AN EAD. ONCE THEY RECEIVE THEIR GC IT IS ALSO OKAY (sorry for the caps but it needs to be obvious to stop people thinking this stamp works for K1's)
