Before I apply for my Green Card

I am currently holding an F1 Student Visa. I've been in this country since 2002. Holding my F1 Status ever since and still going to school pursing a BA degree.

I've been working since 2006. In various companies. Yes! I am paying taxes with W2/W4. Never did under the table jobs, always paid taxes.

Although I never signed a form saying I have any work authorization (EAD), green card or am a citizen I did pay taxes and always signed a W2/W4.

Me and my girlfriend planning on getting married this summer. She's a citizen.

My questions;

- Will I have a huge problem facing me?

- Will UCSCI figure out that I've been working without proper work authorization and deny my application even before it starts?

- What's gonna happen?

- My wife will send her tax transcripts (sponsor papers) will I have to too? If so, they will know I've been working, so am I ruined?

I am a little worried please answer thanks

Did you look at the G325a form? It has a section on employment. Also read the penalty notice. You really don't want to be slapped with misrepresentation charge and get deported.

I hope you weren't using someone else's SSN as that is something that you can't overcome with waivers - that's a permanent ban.

Also moving this topic to AOS from Student, Work and visitor visas as OP is on F1.

You have to declare everything asked from your truthfully. If you worked, you have to disclose that information - it asks for all employment in the past 5 years.

With your SSN, they have no problems finding out who you worked for. You really don't want to be misrepresenting yourself by withholding information.

If you're uncertain about information/advice given to you here feel free to get an appointment with an immigration lawyer to go over your case prior to filing.

i have no intention of withholding any information as I would not I know how USCIS is strict about this, but what am I looking at here then, just because I worked there is no way I will get my GC?

This is just for your tip, may not apply all cases.

No matter what rule is except it is criminial cases involved or some other serious cases, you may be forgiven such as overstay and unauthorized working histories etc.... by AOS with USC.

Emphasize::::: this is just based on my friend's experiences I have seen. Some others might have rejected due to above.

Just wanted to give little hope to you.

AOS from VWP is prohibited anyway, but I am taking it. I sometimes still think that I should have taken proper step.....

Hope that you'd be able to figure out the best way.

I just can tell you that USCIS will always find out about your unauthorized working because it's on your taxes and ssn. They will have total access to your IRS files and more(DMV etc).

also they probably can find out from my SS anyways

god i am scared

I just can tell you that USCIS will always find out about your unauthorized working because it's on your taxes and ssn. They will have total access to your IRS files and more(DMV etc).

i know i wish i'd know what would happen???

Working illegally is forgiven on successful AOS based on marriage to a USC

You will be fine in regards to working illegally. It's not advisable of course, but you are still eligible to AOS. Working illegally doesn't cancel that out.

Stress less :)

**Edit - I should add that your employer could end up in a LOT of trouble if they (ICE) decide to "pop by" and you COULD have problems if you continue to work there and are discovered by ICE prior to your greencard being approved. Personally I would cease working and wait for the EAD or GC.

100% sure that working illegally will NOT be a factor in whether you will get your GC.
