Well I checked the USCIS site yet again today and of course - no action. I finally had enough and called my Congressman and spoke to one of his aides. In a nutshell I told her what the situation is and she said the congressman has a full time employee that strictly deals with federal Governmental issues (ie: USCIS, IRS, etc). She said she would send me a privacy form authorizing the release of private information (which I received 10 minutes later).

I cited on my form the inequity of this system and that folks were recieving their NOA2's within 3 weeks of their application while I've been sitting in initial review since January 8th.

We shall see what happens...

Hi Alan,

I've been reading your "rants" and wish you the best. I hope you get some action on your case very soon...I know it is very frustrating. As for Elsie and I, the petition has flown through the USCIS system...even including a silly RFE which was my fault. I think I know the reason why my petition has gone so rapidly. I told you that I'd done this for my Colombian "wife" didn't I? That petition/approvals and interview were scheduled for 3/12/08...it was a done deal and that took about 9 months from our wedding date of 5/17/07. Maybe they matched my information up with my previous information and that speeded up the process for me? I'm not sure but it sounds reasonable???????

Actually, I wasn't "ready" for all this until June because of my work commitments. But, now that it is happening I am getting excited. Elsie is picking up her Packet #3 on next Tuesday, the 13th of April. She is going to try to get her medical done and get the Police Certificate (if needed) while she is in San Jose next week too. Also, I've sent her the forms, DS-156, DS-156k, etc. almost completely filled out for her...all she has to do is complete some minor information like parents dates of birth and prior jobs/addresses information. From what I can determine, she's nearly ready with her suitcases. LOLOL

In any event, I sure hope you get your NOA-2 soon!! You'll have to post a GRAND ANNOUNCEMENT on VJ when it happens. I am sure there will be many happy people rooting for YOU!! You will get lots of :thumbs::thumbs::thumbs::thumbs:

PS I guess you saw that I had several people "jump my case" :unsure: when I posted my opinion about a "marriage broker" situation. They do that here on VJ! From what I'd read, using a marriage broker DOES create a "red flag" with the USCIS and causes them concerns about the bonafides of the relationship. It should be interesting to read how that person's case materializes. Hopefully all will be ok for them...no problems or issues.

Morning Everyone...

Ok - update on the situation. First of all - of course, No NOA2, USCIS site STILL shows "initial review"... Just for sh**s and giggles, I entered different CSC case numbers on the USCIS portal and EVERY other I-129F submitted on my date has been approved for at least 2-3 weeks (found some approvals from same date submissions as mine approved on March 10)... What total B.S!

I sent the release of information to my congressman (Dennis Kucinich) and ALSO to my Senator (Sherrod Brown). I figured #######, if USCIS won't touch my paperwork on their own accord I'll just annoy the living ####### out of them with a Congressional and a Senator's inquiry into my case.

I sent each politician a 2 page letter basically telling them the the intire immigration process is mismanaged with no equity involved and that USCIS personnel are oblivious to the trauma and damage they cause relationships. I also sent copies of IGOR's list screenshots showing how people who filed in March are already being approved, and a copy of the screenshot showing CSC is processing I-129F's filed on March 1st.

So - I'm not sure what the process is next. I don't know how long it takes for teh Congressman or Senator to make their inquiries or how long USCIS has to reply. I've read some posts where NOA2's were issued 1 week after Congressional inquiry - so I'm REALLY hopeful that mine will follow that same sort of time frame.

As always, you guys get me through some crappy days with your kind words and good wishes. I really appreciate the support my VJ family offers and please know that you're in my thoughts also.. Beer is on me when I get the NOA2!

So - I'm not sure what the process is next. I don't know how long it takes for teh Congressman or Senator to make their inquiries or how long USCIS has to reply. I've read some posts where NOA2's were issued 1 week after Congressional inquiry - so I'm REALLY hopeful that mine will follow that same sort of time frame.

As always, you guys get me through some crappy days with your kind words and good wishes. I really appreciate the support my VJ family offers and please know that you're in my thoughts also.. Beer is on me when I get the NOA2!

Met online in 2002 as friends. Fell in love in 2005. Got engaged in 2010.

K-1 Journey, January 2010-July 2010:

NOA1: January 29. RFE: April 21. NOA2: June 4. Interview: July 15. Visa in hand: July 20. POE: July 22.

July 24, 2010: Married in front of 150 of our loved ones on a beautiful, sunny day. Living happily ever after and oh so thankful that 5 years of a long distance relationship and 7 months of a visa process is condensed into one line.

Adjustment of Status Journey, January 2011-March 2011:

January 25: NOA1 for AOS and EAD. Feb 5: Bio appointment received. Feb 7: RFE. Feb 11: Sent RFE response. Feb 23: AOS transfered to CSC. Feb 25: Biometrics. March 11: EAD approved! March 19: Received EAD. March 21: AOS approved! March 25: GC in hand!

And we'll live happily ever after.. for the next 2 years, anyway.

GOOD NEWS TODAY!!!!!

The U.S. Embassy in San Jose just e-mailed me a copy of Packet #3 and advised me that when everything is complete to call and schedule the appointment. I am so happy and excited. PLUS, as an added bonus I already had most of the forms filled out for Elsie...few minor areas for her to complete. (I'd already sent them to her a few days ago.) Then, call the Embassy!!! So...hopefully we will have an appointment later this month!!! The timing was a little off for me...but, I can adjust my schedule for the one I love with all my heart!!!

Hey Alan,

Thanks for the support. I feel really good today due to the circumstances. Our journey is not complete...just because things went well thus far is no indication that things will continue in that manner. We could get to the interview and be denied for some unknown reason. This is a lot like a box of chocolates...you never know what you're going to get! (Forrest Gump) You can be assurred that I will post a COMPLETE interview. It doesn't seem that many people posted an Embassy Review for San Jose...what do you think? Since I have the instructions and forms now...I could e-mail them to you, if you are interested. That way, you could have a "leg up" and be ready when your file arrives in the Embassy from the NVC. Let me know...ok?

PS I feel your pain and frustration in your recent postings. I've been there, done that! Have you thought that "maybe" it was not a good idea to involve your senator and congressman? I only say that because getting a "politico" involved with your case may require special handling by the USCIS...taking your file out of the mix and responding to the inquiry with written communication, paperwork backup, etc. Technically, you are still very much within the posted timeframes. There is a guy on VJ that is called "pushbrk" who seems to be very intelligent and knowledgeable about everything visa related. Have you PM'd him to get his take on your situation? I'd trust his judgment. That's what we're all here for...and he's helped a lot of people with his knowledge. (Also, persons known as "sachinsky" and "TboneTX" seem knowledgeable.)

Then she called me about 2 hours later and told me that CIS emailed her that my petition was put in the mail yesterday 7 Apr ... destination NVC ! I'm not jumping up and down yet until I hear one of those operators at NVC tell me yes and give me a number, but I think it was a good idea that I called my local office .... Hope you hear something very soon !!!!!!!!!!!!!!!!!!!

Isn't it sad that you have to involve a Congressman in order to get USCIS to simply do their job? I've said it before and it still holds true (more so every day)... If USCIS was a privately owned and run company, they'd be put out of business due to poor customer service. I realize that they process literally millions of documents every year, but so does Fed-Ex, UPS and other companies (who do so in a much more efficient manner).

What makes me angry is that not only are our Federal tax dollars utilized for the USCIS but we as petitioners pay a premium to use their service.

I'd love for someone from USCIS explained how a petition gets lost in transit to NVC or explain how petitions filed 30 or 60 days later than mine can get processed BEFORE mine (I'm not talking about expedited petitions).

Anyway - I truly hope your petition arrives safely at NVC and is passed through to the Embassy really quickly.

PS I feel your pain and frustration in your recent postings. I've been there, done that! Have you thought that "maybe" it was not a good idea to involve your senator and congressman? I only say that because getting a "politico" involved with your case may require special handling by the USCIS...taking your file out of the mix and responding to the inquiry with written communication, paperwork backup, etc. Technically, you are still very much within the posted timeframes. There is a guy on VJ that is called "pushbrk" who seems to be very intelligent and knowledgeable about everything visa related. Have you PM'd him to get his take on your situation? I'd trust his judgment. That's what we're all here for...and he's helped a lot of people with his knowledge. (Also, persons known as "sachinsky" and "TboneTX" seem knowledgeable.)

I not worried about ruffling any feathers at the USCIS by asking for a congressional inquiry. My opinion is that if there was any equity in the first place I'd have my approval with other folks who filed in early January and my petition would already be either at NVC or at the Embassy.

I know that I'm within the 5 month posted USCIS guideline for I-129F processing and if other I-129F's were taking that long to process and be approved then I'd just shut up and accept it - but - I've gone to the USCIS portal, randomly checked other I-129F's from dates AFTER mine and they've all been approved for 3+ weeks. I'm not asking for special treatment, just asking that mine be processed in the order that it was received. I paid my $455 just like everyone else and just want to be treated like everyone else. My petition was completely and accurately prepared, I gave more than the required minimums for proof of having met, have no criminal history so my petitin should be as easy to process as the next. What bothers me the most is that it hasn't even been touched since January when I filed...

As far as me asking senior members for their input... What really can they say? I know I'm under the 5 month guideline time and frankly I don't want to be told that I'll just have to wait... I figure the worst that can happen by me asking my congressman for help is that I'll be told "I have to wait"...

As for your kind offer to send me a copy of the packet 3, I'd REALLY appreciate it. I know I have most (if not all) of the paperwork done that we'll need for the interview, but I'd really like to see ALL the requirements for the Embassy (especially what they have to say about approved Dr's for the medical and police certificates). PLEASE email me a copy of your P3.

So - hopefully some sort of resolution soon to this mess. I'll keep you all posted.

Updated stuff!!!!!!!!!!!!

Ok - I called the Congressman's office this morning, spoke to the aide who handles immigration issues. She said she had received all my documentation I sent her and would make the inquiry and call me back. 15 minutes later she calls me and says that USCIS CSC told her I was still within the 5 month processing guideline and that was the end of the story. I thanked her for her help and hung up.

I pondered that for a few moments and called the Congressman's office back. A nice kid (an unpaid intern) answered the phone and I told him the story about how my petition hadn't been touched since early January, etc... He pulled the documents I had sent them and told me to hang on.

Next thing I know I hear the noise you make when you're using dialing a number. USCIS comes on the phone and the intern tells the customer service rep that Congressman Kucinich is waiting on hold to speak to someone (somehow I got confrenced in on this). THE CONGRESSMAN himself got on the phone and I hear him ask the CSC employee about the status of my petition. The CSC employee told the congressman that I was within the 5 month processing guidelines. The congressman then asked to speak to an adjudicating supervisor and the wait time was less than 30 seconds before another voice came on the phone...

The congressman asked the supervisor about my case, explained that MANY other cases had been adjudicated and approved after my petition was submitted. The supervisor told the congressman he'd look into it and that was the end of the call.

20 minutes later I received a call from the Congressman's office telling me that my case is being processed and they were able to give me Vanessa's "A" number (her alien number). The Congressman's aide told me I should have my NOA2 by Monday unless there is a reson to issue a RFE...

I have no idea what Vanessa's "A" number is for, but at least I know my petition is no longer sitting in the corner of a dark closet at CSC... Hopefully good news to follow soon!!

I'm still sitting here in shock at actually hearing the Congressman on the phone with the USCIS. They were sure a lot nicer to him than they were to me ... lol...

I'll keep you updated!!!

OMG! That's amazing! Congratulations! You deserve every last bit of justice! CONGRATS!

(I'm just in a good mood cos I got my wedding dress in today, but that's a thousand times better!)

Before Journey:

Met online in 2002 as friends. Fell in love in 2005. Got engaged in 2010.

K-1 Journey, January 2010-July 2010:

NOA1: January 29. RFE: April 21. NOA2: June 4. Interview: July 15. Visa in hand: July 20. POE: July 22.

July 24, 2010: Married in front of 150 of our loved ones on a beautiful, sunny day. Living happily ever after and oh so thankful that 5 years of a long distance relationship and 7 months of a visa process is condensed into one line.

Adjustment of Status Journey, January 2011-March 2011:

January 25: NOA1 for AOS and EAD. Feb 5: Bio appointment received. Feb 7: RFE. Feb 11: Sent RFE response. Feb 23: AOS transfered to CSC. Feb 25: Biometrics. March 11: EAD approved! March 19: Received EAD. March 21: AOS approved! March 25: GC in hand!

And we'll live happily ever after.. for the next 2 years, anyway.
