    I beleive the reason for the RFE is obvious... There isn't any suggestion that photos alone are sufficient evidense of meeting in person in the last 2 years.. It has always been secondary evidense.. nothing has changed from USCIS Perspective.. Primary Evidense is Boarding Passes, Passport stamps, hotel & Credit Card Reciepts.. Photos are necessary, but is secondary evidense and should never be excluded from you initial submittal..
    As far as birth certificates, it is the same as always.. Copies are fine.. If they need the original, they will ask for it at the interview.. Always send copies of your personal documents and evidense. The originals can be shown at the Interview...

    ONE OTHER CRUCIAL DISTINCTION IS:
    THere is a huge diference between "proof of meeting in person within the last 2 years" and "Proof of ongoing relationship"... To be succesful, you must keep that distinction clear and separate..
    You need to show proof of Meeting in Person within the last two years for your Initial Petition (I-129-F) This include both Primary Proof and Secondary Proof..
    Then after the Petition is approved...
    You will need to show proof of On-going relationship to the Conusalte Officer durring the interview.. You will also need forms of Primary Proof as well as forms of secondary proof...

    There are at least a dozen credential evaluation companies in the US. Each specializes in differing areas. Don't hire one until you have been told by a specific institution which one they like.
    For example, I had a teaching certificate in Canada. When I contacted the Utah State Office of Education to get a Utah teaching certification, they told me to get my Canadian education degree evaluated, using one of the four-to-six credential evaluation companies they list on their website. If I had jumped the gun, and gotten a credential evaluation from a different company, the Utah education office may very well have not accepted it.
    Generally speaking, you will only need to get your degree evaluated if you are attempting to get a specific professional certification. Wait until the certifying institution tells you to get it done, and have it done by [one of] the specific company[ies] that specific institution likes.

    Well let's see, one would probably be able to infer by my comparisons and pretty much by the overall message of my post that I don't agree with those who feel that Islam is an across the board religion of violence.     You're baiting in this thread...I choose to not rise to the bait. That's how I'm suggesting you deal with it. I realize it's frustrating, but what have you been trying to accomplish all these years? Do you think you're going to singlehandedly change opinion for those who aren't listening? It's obvious you're not going to do that. You are smart enough to realize that, yes?
    In fact, I'd dare say that your current approach is actually solidifying anti-Muslim opinions for some.
    I don't personally care what you do...fill your boots either way. But I will comment on it when I feel like it.
    There are people on this thread, including yourself, who have bashed Christianity. Others have bashed organized religion as a whole. While it offends me, what can I do about it? Nothing. So instead of getting into a sh!t fling, I choose to occasionally comment, but otherwise, not engage in a religious discussion with those whom I feel will never be open to seeing a different point of view. In other words, I pick and choose my battles, and I try to prevent myself from rising to some bait on a mb.
    I certainly wouldn't justify some crazy Christian's actions of bombing an abortion clinic by bringing up ancient history of other, more deplorable heinous acts as if some how it mitigates what was done. I would never put myself in a stance to defend the likes of WBC, who call themselves Christians, but to me are nothing but hate and fear mongers. I wouldn't be all 'hey, the Nazis are worse' as if that's somehow relevant, which it's not.
    I've been incredibly fair here, imo..I have put myself in your shoes and realize it must be frustrating to hear such negativity about your faith. However, you're doing your faith a huge disservice with your approach lately.
    Nice that you didn't respond to any other part of my post, which I think was quite fair. I think the selective silence is very telling. But eh, that's how you roll, so I'm used to it by now.

    A B-2 is not VWP. They end up being very different for this. It is illegal to enter the US with intent to immigrate on either, however. From your post earlier you said your wife got here a week ago and you want to AOS already so it seems like you are evading US immigration laws. Most people who adjust from B-2 have a period of overstay or have a sudden change in circumstances... it's hard to have a sudden change of circumstances in one week.
    At any rate, once you file for AOS you begin another period of authorized stay.

    Keep in mind that he is potentially subject to interest and penalities for the back taxes, and that he will probably OWE taxes to the IRS.
    Also, as scary as this might sound...
    Go ahead and call the IRS. Do it from a public phone if it makes you feel better and you can stand sitting on hold that long. While the wait to talk to them is horrid, I have ALWAYS had them be very helpful in sending what I needed and answering ALL of my questions and in a polite efficient manner. You should be able to find someone there who will give you all of the answers you need and in a timely manner. Here is their info:

    It says here that you can leave for up to a year without obtaining a reentry permit. So, "officially" it is ONE YEAR, not six months. It also says that visits outside of the US for even less than a year can be considered for abandonment of status (I read this is as for people who have continued prolonged absences from the US, not a one-time thing). I don't trust these lawyer blogs who talk about how more than one year needs a reentry permit (which is true) and then conclude that therefore 6 months is max...

    Overstay and illegal employment are irrelevant in processing petitions based on marriage. However, they have to be satisfied that you have a genuine marriage and are not filing solely for immigration benefits. You say you don't live together and you met as a patient and she was your caretaker and continues in that role. You will have to overcome that. I don't think you should be worrying about the work... it will be irrelevant.... it will be forgiven... IF you tell the truth. If you lie about anything they will suspect something is fishy and catch you in your lie and that will be it. It is a nerve-wracking process for everyone. Good luck.

    It is huge. What he means is that if he entered legally, and has become illegal by overstaying their visa, there are paths to becoming legal (namely marrying a USC spouse). If he entered illegally, without inspection, there is hardly anything they can do to become legal.

    Baron is wrong. The marriage certificate is a REGULAR photocopy. Not a certified copy. You can send certified of course but sometimes those cost money and the paperwork only requests a regular photocopy anyway.
    The AOS thread in my signature has the full list of documents required. I too am surprised you claim you didn't know about AOS. Not only is it told to her at the K1 interview, information about it is also typically given on a piece of paper when the K1 is approved, and then at POE they tend to remind people (not always) that AOS is required.
    There is no penalty for working illegally unless she is caught. Her income cannot be used to help "boost" your income in the Affidavit of support because she was working illegally. If she is caught working by ICE she will be punished. Usually a heavy fine for her and the company. Ignorance of the rules isn't an excuse and she probably will be locked up in detention until you pay to bail her out. So STOP WORKING. Her work should have asked her for proof she can work NOT TO MENTION when she got her SSN it says "DHS Authorisation Required" on it.. what did you think that meant?????

    Once you have your GC, PoE is much easier. You just show them your passport and GC. They'll ask some basic questions. They might take your photo and fingerprints on a machine in the booth. And that's it. Because you'll have your GC, they won't be reevaluating your admissibility or anything like that. the vast majority of people who enter with a GC get basically waved through. They won't have access to your medical or any of the adjudication notes. It should be no problem.
    My PoE with my K-1 visa was no fun either. The grumpy officer spent 90 minutes flipping through my file, cross-referencing with his reference binder and asking the odd pointed question about things that I included in my I-129F petition packet. But my PoE entering with my GC, coming back from a work trip to Japan, was very easy, as I described above. No problems at all.

    Getting information out of you is like pulling teeth!
    Yes, he was out of status. If he remains in the US, but discontinues his studies for a period of 5 months or more, then his status has ended. "Duration of stay" requires that he continue his studies as a prerequisite to maintaining his status.
    You said he "couldnt finish school because of financial reasons. a few years later, he got married to a USC and filed for AOS". A few years would be more than 5 months, so he's out of status. A few years is also more than 180 days, and more than 1 year, so he has a 10 year ban that began the day he left the US. The period of time that his AOS was pending is not included, as he is granted a temporary period of authorized stay while the AOS is being adjudicated. He didn't adjust status, so the overstay remains. He'll need an I-601 waiver to return.

    Okay. I will tell you a secret: the key to proper advice is information. If I'm a doctor and you tell me you have nose bleed but forget to mention that somebody threw a 200-lbs. steel plate on your chest the night before, I might not be on the right track.
    I understand the F-1 with the D/S, the canceled AOS, and that the guy left the country.
    But when was that?
    Did you come back? If so, when?
    What visa are you applying for?
    And so on. You give me information, I'll give you answer. Very easy. Like eating salad.

    From whoat you've stated above it sounds like you submitted the 2009 tax return without any of the supporting documents (such as W2, 1099, and any of the tax schedules ( these are forms that are filed in conjunction with a tax return). The RFE is asking for the missing supporting docs. I suggest that you submit a complete copy of the package used to file the tax return. Or, you could obtain the free of charge tax transcript ( Tax Transcript Info ) by calling 800-829-1040 and send that instead of all the documents.
    A Schedule is something that a filer provides, not the IRS. You may have confused the terms.

    I'm going to start backwards to answer your questions. As a disclaimer i am going to say i am not an expert, but i just send off my paperwork so i do know a little bit about this process.
    1.Yes, you will have to have your I-693 before you submit the package, that goes together with the package(the envelope with the I693 from your doctor remains sealed).
    2. With the I-864 you will need: last 6 months pay stubs, employment letter, last year's tax return along with W2, OR tax transcripts if you have
    3.form G-325, you will need 3 of them, 2 completed by the beneficiary(your wife)1 goes with the I-485, and one goes with your I-130(your petition), then you will need one completed by you the USC, that will go with your I-130. SO the I-130 will have 2 G325 one of yours and one of your wife.
    4. You will need 7 picture of the beneficiary if she will also complete the I131-advance parole(in case she has to leave the country while the green card process is still happening, and one of yours(usc)and they are attached as follows: 2xI-864, 2xI-765, I-131, and 1xG325.
    5. the fee for I-130 is $355, and the fee for I-485 is $1010. The amounts have to be exact otherwise they will not take your case.i made 2 checks , but some people do one check. whatever you want to do, i'm sure it will be fine.
    6. Not sure where your wife is, but if her birth certificate is in another language than english she will have to get it translated and certified into english.
    Also i think you also need to add some copies for the I765 form like passport copy, i added passport copy on biographical page and visa page.
    I made 2 cover letters one for I-130, and one for I-485where i included all the copies and the rest of the forms(I-765, I-693, I-131,I864)
    Let's see what other people are saying as well, because maybe having a child changes a bit the doc's that you might need, but for the most part, i think this is it.

    No, she'd still have to get all her visas on the basis of her Iranian citizenship. Once she gets US citizenship, that will change, but not for a greencard.
