  4. I don't have to start filing until April 15, but I'm starting to gather evidences. I was wondering if I still needed IRS transcripts or the joint Income Tax Return would be sufficient?

    I read the VJ forums. IRS tax transcripts are preferred because it is way easier to just order them and know that all pages and all information are there. But The Joint Income Tax Return 1040 is ok too.

    Our current house is still under my husband's name as he bought it longer before our marriage.

    Too troublesome to add my name and we currently have no plan to refinance the mortgage.

    As for Affidavits, we don't like to trouble friends or family members to write one for us.

    We should have sufficient evidences for ROC :)

    Hopefully there will be no RFE or interview for us.

    I am more worried about Biometrics, because I had to do it twice during AOS since the machine could not read my finger prints!

  7. My AOS was approved without the NOA2 copy too. :yes:

    In lieu of the I-797 approval notice (NOA2), I submitted

    - National Visa Center letter,stated that the I-129F was approved and that the petition will be forwarded to the consulate.

    - Infopass letter & the USCIS computer print out(by the local USCIS officer) shown the I-129F petition was approved.

    - US Consulate processing K1 visa letter

    - my K1 visa stamp & I-94 entry stamp

    - USCIS website case status online print out, showing the I-129F was approved.

    - NOA1, receipt to show that we did file for the I-129F petition

    - USCIS case status update emails

    My AOS I-485 was accepted and transferred to CSC for processing, no AOS interview. There was no RFE for the missing NOA2.

    My AOS I-485 was approved within 3 months.

  8. Since your fiance is only here in US since May 25th, the 90 days limit is not exceeded yet. Call up the US Embassy in Philippines to ask if they would reissue the K1 visa based on "9 FAM 41.81 N6.3 Reissuance of K-1 visa", whereby your fiance has to re-enter US and get married within the 90 days limit starting on her FIRST ORIGINAL arrival date May 25th.

    If the US Embassy in Philippines does reissue the K1 visa, she has to re-do all the medical (because the medical forms are in the package submitted at POE), police clearance check, I-134 forms, proof of family emergency.. etc and the K1 visa interview again at the US Embassy, which is not easy within the limited timeframe.

    => All these and re-entering US, marriage must be completed by May 25th + 90 days which is roughly August 22 2011.

    Otherwise, she will need to restart I-129F / K1 visa from scratch.

    some officer and tell the entire story. I do not want to do this over the telephone, somehow

    it doesn't seem to me very serious. I need to talk to somebody in person.

  11. years ago, my best friend's little sister was pregnant and homeless. i let her stay with me. about a month in she was a nightmare, arguing constantly and in general being intolerable. i asked her to leave. she refused. she went across town to visit my best friend and i took the opportunity to bag up her things and bring them to her, at her sisters house. i carried all her stuff up three flights of steps - all the while taking care of her things. afterall, i've had known this girl since she was eight and had no intentions of ending our friendship.

    she opened the door,looked at her belongings and laughed at me -saying, you can't do that, i'm calling the cops.

    i laughed it off and pulled up a seat - waiting for the cops to show up thinking that since i was the person with the lease and i had only offered to let her stay till she had a job and some money (of which she had both at the time).

    sure enough, the cop told me that if someone lives in your residence for 30 days - you have no legal presence to kick them out other then formally filing to have them EVICTED. i would suggest going to your local courthouse and getting a court date. that is the only way to have them removed. and i would think that getting them evicted would be much faster than waiting on their visa decision and ICE.

    these are the laws in virginia, i'm not sure if the laws are the same where you are - but if the cops have backed them about the thermostat thing, and there's a baby involved, doesn't look like you have many options.

    she ended up leaving on her own in a couple days. i think her sister (my friend) talked some sense in to her young head. we're friends now, more because we are all like family, but good luck to you..i know how difficult it is to have someone fault you for being a good friend.

    For the I-131 re-entry_permits processing time, I could mostly find the time frame is roughly 3 months (according to the California Service Center, Nebraska Service Center, Texas Service Center USCIS website).

    Also, you may have the USCIS to mail the re-entry permit to US Embassy in Singapore then you pick it up from there, but you must make sure you have enough time before departing US to do the biometrics for the I-131 re-entry permit.

    Maybe do a walk-in biometrics at the local USCIS field office once you get the Biometric Appointment letter? Or ask for I-131 expedite request, since you are going back to SG in May, the timing seems a bit tight for you. The instructions for requesting an expedited application are on the I-131 Instructions.

  13. Singapore doesn't allow dual citizenship.

    When the time to renew your Singapore passport, the application form has a declaration where you need to declare if you have acquired the citizenship of another country or not.

    PART II – DECLARATION AND CONSENT

    I declare that:

    a) The particulars and information, including documents, furnished by me in respect of this application are true and correct to the

    best of my knowledge and belief, and that I have not wilfully suppressed any material fact.

    b) I am/The child is* a citizen of Singapore.

    c) I/The child* have/have not/has/has not* acquired the citizenship of another country.

    If you lie on that question and are found out, well, it might not be good if you are forced to renounce one citizenship or the other.

    Maybe in the future, Singapore will allow dual citizenship.

    I'm sorry about your current situation. US economy is still not good, with high unemployment rate. I hate driving but forced to do so because public transport system is bad. It is even worse to drive during snowing.

    You could turn in your green card at the US Embassy in Singapore (I saw people doing that during my visits to US Embassy for visa interviews).

    Then apply for spouse visa when you are ready to settle back in US.

  14. Obviously, the I-129F must have been approved, or else the K1 visa would not be issued at the US Consulate.

    But according to I-485 instructions, you still need the NOA2 for AOS from K-1

    -> Attach a copy of the finace(e) petition approval notice and the marriage certificate.

    My husband didn't receive any NOA2 at all and he didn't know that we need it for AOS.

    USCIS refused to send us a duplicate copy for free and asked us to file I-824 instead which is so expensive (used to be $340, now is $405).

    For my AOS,

    In short,

    We sent out the I-824 forms without the fees, letter to explain the situation and evidences of K1 petition.

    Unfortunately, the I-824 form was returned to us one and half month later for "I-824 fees not included".

    For the AOS,

    I did a write up to explain the whole situation, and in lieu of the I-797 approval notice (NOA2), I submit

    - National Visa Center letter,stated that the I-129F was approved and that the petition will be forwarded to the consulate.

    - Infopass letter & the USCIS computer print out(by the local USCIS officer) shown the I-129F petition was approved.

    - US Consulate processing K1 visa letter

    - my K1 visa stamp & I-94 entry stamp

    - USCIS website case status online print out, showing the I-129F was approved.

    I would suggest you included in your AOS package the email from USCIS saying they have concluded the NOA2 must have been lost

    and that you can use a copy of the notice on their website. I thought contacting the Congressman will be the last resort should there be RFE for the missing NOA2.

  16. We never realized that we need NOA2 to file for AOS(I-485, based on I-129F/K1 visa) until we got married almost 1 year later.

    I-485 form instructions:

    12. Evidence of eligibility

    B. Based on admission as the K-1 fiance(e) of a U.S. citizen and subsequent marriage to that citizen

    Attach a copy of the fiance(e) petition approval notice, a copy of your marriage certificate, and your Form I-94, Arrival/Departure Document.

    We never received NOA2 at all.. Tried to call up the USCIS hotline, as usual they only wanted us to pay $340 for the duplicate copy. Then got an infopass to speak with local USCIS office about the missing NOA2. We have been through a lots of effort trying to get the NOA2, refused to pay the $340. In the end, we filed for AOS I-485 without the NOA2, hoping for the best not to receive RFE for the missing NOA2.

    There were previous cases where people didn't receive the NOA2 and try to file for AOS without it.

    Please read, then you will know it is hell of trouble with the missing NOA2.

  17. Hey April peeps!

    I received an RFE for my AOS on July 8th. They basically lost my medical, so I have to get it redone. I pick up my results on Wednesday and will then ship it back off to USCIS. Anyone have any experience to know how quickly my case will resume/approve once the RFE is returned?

    From what I have read from the forum, as soon as USCIS get your RFE package your case status will be updated showing that they received your response and that your case continues...

    Just get your SSN 2 weeks after you arrive and BEFORE there are only 2 weeks left on it. Do you mean apply 2 weeks after I arrive... what do you mean BEFORE there are only 2 weeks left on it.. on my k1 do you mean?

    I know I will have to wait 2 months until I can work but I won't be bored...I'll be with my new wife! Being with her is what all this is for... starting work will be the boring bit lol.

    Once you enter US, your I-94 will be stamped with 3 month validity (90 days to get married in US).

    Yes, try to apply for SSN 2 weeks after you arrive, not when there is little time left before your K1 status expires, meaning I-94 about to expire.
