If you are newly married, it is understandable that you don't have much stuff together yet as a couple.

But for ROC (after 2 years of marriage), one should have some sorts of co-mingle finances to prove on-going relationship.

E.g. Jointly-Filed Taxes, joint credit cards, bills, both listed on insurances ..etc

Letters/Affidavits could be fabricated and at best only secondary evidences.

So just fill up the ESTA

How about planning the trip out of the country after you have received the Biometrics letter?

At least you will have a clearer picture of the dates...

If you receive the Biometrics letter before your trip, you could attempt a walk-in, not waiting for the actual Biometrics date.

The USC has to take the huge leap of faith to sign the I-864 too.. and get stuck with it even after divorce.

Both sides have to give and take.

As to protect one asset during a divorce, it also depends on which state you reside in.

Then your husband has to be at the interview with you.

Anything could happen in a marriage.

My issue is simply this - none of us WANT to be apart from our loved ones so why are people here on visitors visas more special than other couples? AOS is simply not necessary for these couples. Go back to your country and process a fiance/e or spousal visa.

If it really is just about being a courtesy for the USC, then let any spouse of a USC just come here on a VWP or visitor visa and then adjust their status. Why keep those couples apart just because other couples are lucky enough to come from VWP countries, or were able to get visitor visas? It's just not fair to other couples.

Yes I'm sure there are lots of couples who actually plan it. We'll never really know the real figure because no-one will ADMIT immigration fraud.

There are people saying "what if I miss the birth of my child?" well other people DO. Why are you more special? because you were able to get a visitor/student/work visa or come on the VWP? "what if I can't visit?" well other people can't either.

The playing field needs to be leveled. It's legal to "change your mind" of course, I'm not disputing that some people have done it "legally" but it should no longer be legal just to change your mind. Go back to your country and process a visa like everyone else or let everyone else in a relationship with a USC just come visit and AOS.

Next time, please be truthful in your replies to COs when applying for visas in whichever Country Consulate.

My fingerprints are not easy to read either.. the ridges are wearing off due to using too much computer.

I did the biometrics twice during AOS because the first time, FBI could not read the fingerprints.

They would probably send you another biometrics letter to re-do your fingerprints again.

Try walk in with the second biometrics letter, don't wait for the appointment date.

If that fails again, you have to get all the police records from where you have lived in the US.

Does your J1 visa in your passport stated that you are subjected to 2 year home residency requirement?

Things learnt from story : Never send out invitation letters to be used for other people tourist visa applications (except maybe your immediate family members). Who know what their true intention might be.

At least the "Best friend" left your friend's house without causing further trouble.

I-751 Sent = The Date you sent your application

NOA Date = The Receipt Date on your original NOA letter

Biometrics = The Date of your biometrics appointment

Approved = The Date your case was approved which is the date on your approval letter

GC Received = The Date you get your card in the mail, NOT the date on the letter

USCIS will send you a letter about the Service Request that you filed.

The letter will tell you the status of your serivce request.

I filed a Service Request for my I-751, outside Normal Processing Time.

13 days later, I received a letter from USCIS about my service request status.

If you have not heard from USCIS after 15 days, you could call USCIS back,

citing the number that the service center person gave you before.

She does not need to give up her Malaysian Citizenship.

She will be Legal Permanent Resident in US (Green card holder).

K3 is obsolete. CR1 is the way to go.

While you are in US, your spouse could start the CR1 process by filing I-130 form.

Then you leave US when your authorized stay is up, and prepare for the medical and interview at your home country.

This way, you minimize the time of separation from your spouse while waiting for CR1.

Fraud would be to get married for the wrong reason and just in order to get the green card.

I know people do it everyday and being apart from the person you love for 8 to 10 months is a lot. I'm not saying the US immigration is doing the wrong thing but when it happens to you, you feel it is unfair and you want to find any solutions.

i just wanted to know if some people got married on a B1 and did an overstay and how did it work for them.

I'm not asking for help just for sharing experiences.
