  1. I just received email and text msg that

    "On July 1, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283."

    My AOS has been approved right?!?

    So excited! Given that I have missing NOA2, (submitted other supporting documents to prove that I-129F was indeed approved), 2 K1 visas(1 original K1 and 1 reissued K1), 2 Biometrics (1st Biometrics failed because FBI couldn't read my fingerprints).

    So many hiccups in my K1/AOS journey, draining me mentally and physically. I am so happy now :star:

    By the way, what is "ADIT processing" ?

  2. You can call up your US Consulate to see if they would do the reissuance of K-1 Visa or not.

    If yes, the US consulate officer would advise what to do next.

    You mentioned that "US Embassy suggested that the only option is to restart the K-1 Application.", then they probably won't do the reissuance of K1-Visa.

    The reissuance of K-1 Visa is really up to each individual US Consulate.

  3. I entered US on 24th Dec 2009 on K1 Visa. Due to work emergency, I have to leave US before getting married, on 18th Jan 2010. It was really unfortunate because we didn't know if I can still enter back US on K1 visa again. OR we need to restart the K1 I-129F petition again.

    After searching forums online, managed to get the information about reissuance of K-1 Visa.

    9 FAM 41.81 N6.3 Reissuance of K-1 Visa

    (TL:VISA-2; 08-30-1987)

    If a K-1 visa, valid for a single entry and a 6-month period, has already been

    used for admission into the United States and the alien fiancé(e) has

    returned abroad prior to the marriage, the consular officer may issue a new

    K visa, provided that the period of validity does not exceed the 90th day

    after the date of initial admission of the alien on the original K visa and

    provided also that the petitioner and beneficiary still intend and are free to

    marry. The alien’s return to the United States and marriage to the petitioner

    must take place within 90 days from the date of the original admission into

    the United States in K status.

    I applied for the reissuance of K-1 Visa at my country Singapore US Consulate. Before that I have to resubmit all the forms and documents based on the K1 visa checklist again => I-134 Affidavit of Support, New Police Record and New Medical Report. All these documents preparation and schedule new interview date take about a month.

    Freaking nervous attending the interview US Consulate, expecting the worst, (yes, I have to pay the K1 visa fee again).

    However, after much intense questioning, US Consulate officer agreed to re-issue me K1 Visa.

    Based on the rule of Reissuance of K-1 Visa: My Fiance and I have to get married within 90 days from my original admission into US (24th Dec 2009), meaning get married before 23th March 2010, which we did.

    The reissuance of K-1 Visa is really up to each individual US Consulate and the time to schedule the K1 visa interview again (must be within the initial 90 days from the first admission into US, and enough time to travel back to US to get married).

    I checked with the clinic that you went to yesterday and they asked for 220 USD. Did you do the TB test and others there or you had that done somewhere else?

    I called up the clinic, told the nurse Brandie that I am adjusting status from K1, thus I don't need full medical examination, only transcriptions of vaccination records to I-693 forms. I also emailed my DS-3025 in advance, told to get another shot of MMR (need 2 shots of MMR but I only had one stated in DS-3025) before the appointment date, much cheaper price at local public health department.

    But went to CVS Minute Clinic instead, paid $67 for the MMR shot.

    Other than that, I didn't need to do TB test as my DS-3025 form is within a year and the record say "Vaccination history complete".

  6. There shouldn't be any problem with a walk-in.

    Just avoid any snide remarks about their lack of "quality control" wacko.gif

    and you should have no problem.

    I did a walk in this afternoon, the lady guard at the ASC was really nice and polite.

    I still have 3 rejected fingerprints => the 2 prints with my 4 fingers together from each hand and my last individual left pinky finger.

    The lady doing my fingerprints scan said that I have to wait for letter to see if my fingerprints are ok this time. There is nothing I can do when my fingerprints ridges are hard to read. This is driving me crazy.

    What if I failed Biometrics again?!?

  7. You have two options.

    File the I-824 WITH a fee waiver (letter explaining why you did not include the fee and requesting they waive the fee) They will not waive the fee unless you ASK them to waive the fee and explain why.

    OR

    Contact your US Senators office and have them get ahold of the congressional liason at whichever Service Center handled your case

    Your AOS will NOT be approved based on a copy of the K-1 visa. The local officer is wrong. You will get an RFE is you send it without the copy of the NOA2

    I already mentioned that "We tried that, sent out the I-824 forms without the fees, letter to explain the situation and evidences of K1 petition.

    Unfortunately, the I-824 form was returned to us one and half month later for "I-824 fees not included". USCIS just wants more money, totally unacceptable.

    So far I have no RFE yet and case is transferred to CSC (same service center as my I-129F petition).

    If there is RFE for the missing NOA2, I will contact Congressman/Senator for assistance.

    I have read that there are cases of AOS being approved without NOA2. So just wait and see.

    Paying $340 for the duplicate copy is ridiculous, and it is no fault of ours that NOA2 is not received!

    Maybe you can reflect that to your USCIS friend, director at the VSC.

  8. Just finished my Biometrics Appointment today. The lady taking my biometrics said my fingerprints are light to read. So I asked if there would be problems? She said she doesn't know, need to wait for the FBI to report back.

    Now, how to know if the Biometrics are ok or not? How long would USCIS take to inform me if I need 2nd time fingerprinting?

    Ok I checked that my I-485 and I-765 are touched today. So does that mean my Biometrics are ok??!?

    I think I will call up USCIS Customer Service hotline tomorrow to double check.

  9. Hello, I am in the same situation like you, my husband never received the NOA2 at all. And I have filed for AOS in April 2010 without the NO2.

    Here are what we have done:

    Calling up the National Service Center many times does not help at all.

    They just want us to pay more money for a duplicate copy which we did not receive in the first place.

    We went for an Infopass appointment at our local USCIS. The local officer said that my K1 visa stamp in the passport is the best proof that the Fiancee I-129F petition has been approved. He said it is almost guaranteed that I won't have problem with AOS. He also printed out from his system to show our case status process, that the petition had been approved on March 26th, 2009 and the approval notice was sent out which we didn't receive. If only the USCIS people are so understanding like what the officer said....

    The local officer also mentioned we could try to send out the I-824, explaining that we didn't receive NOA2 at all, hence the $340 fees not included.

    We tried that, sent out the I-824 forms without the fees, letter to explain the situation and evidences of K1 petition.

    Unfortunately, the I-824 form was returned to us one and half month later for "I-824 fees not included".

    Ha ha ha.. So USCIS just wants more money to process the duplicate NOA2!!

    Previously, the USCIS case status website still showed that our I-129F case is under Initial Review. After so much complaints, the USCIS finally updated the case status online that Current Status: Approval notice sent on March 26, 2009.

    For the AOS,

    I did a write up to explain the whole situation, and in lieu of the I-797 approval notice (NOA2), I submit

    - National Visa Center letter,stated that the I-129F was approved and that the petition will be forwarded to the consulate.

    - Infopass letter & the USCIS computer print out(by the local USCIS officer) shown the I-129F petition was approved.

    - US Consulate processing K1 visa letter

    - my K1 visa stamp & I-94 entry stamp

    - USCIS website case status online print out, showing the I-129F was approved.

    - NOA1, receipt to show that we did file for the I-129F petition

    - USCIS case status update emails

    Obviously, the I-129F must have been approved, or else the K1 visa would not be issued at the US Consulate!

    It is unreasonable that extra money ($340) on top of the AOS fees($1010), to be paid for a duplicate copy of NOA2.

    USCIS certainly has the records/database to check that the I-129F was approved in the first place.

    My AOS I-485 is accepted and now transferred to CSC for processing. Hopefully there will be no RFE. Keeping my fingers crosssed now.

    Otherwise, contacting the Congressman will be my last resort should there be RFE for the missing NOA2.

  10. I got an email from USCIS on May 7:

    On May 7, 2010, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our CALIFORNIA SERVICE CENTER location for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Is it good or bad? Will I get my AOS approval faster?

    My biometrics appointment is on 5/18/2010 though ...
