Inky got a reaction from annie1 in Do I need a lawyer? CR1
1000$ is WAY too much to spend. They do not care they don't make sure there are no mistakes on the forms. You pay them the money - they make YOU get all the papers and then all they do is fill in the blanks.
You can do it all yourself - for free - not to mention the fact that you have more time to make sure there are no errors.
VJ has example forms filled out and step by step guides showing what you need. - all free all available right here.

Inky got a reaction from user19000 in ROC before 2 year conditial residency, involving a divorce
Before she files for ROC she has to be divorced. Start the divorce now and when she has the certificate then file for ROC. She can include any information she has about the marriage being in good faith but just not working out.
She will go to an interview most likely.

Bad mistake. File them concurrently. Really, stop worrying about what mom said. Your relationship is legitimate and you're following the correct procedure.

Inky got a reaction from TBoneTX in After Point of Entry
Yes - please see the guide section for adjustment of status its step by step.
You file AOS as soon as possible after marriage. SSN is not needed to file AOS but its good to get it as soon as you can.
-
Inky got a reaction from TBoneTX in Quick question! Help much appreciated
File the papers with your new address on them. File the change of address forms. Include a copy of the change of address stuff with your package. That way all bases are covered since a green card holder must file a change of address by law.

Inky reacted to Jozin in Child of American question
Yea, to get citizenship outside of the US it comes in Passport form, mostly because they require this if I choose to enter the country, I need to use my US Passport. There are 3 separate forms they ask to have filled one, a form to determine if I relinquished my citizenship at one point, the passport information and then the questionnaire to explain parentage and such. Im still uncertain if I have this right to claim citizenship, but I guess the appointment with the Consulate will tell.

Inky reacted to Harpa Timsah in Unable to Understand Aproval Notice of I-130
Dwheels, you are almost on track but the OP must also file I-130 because that establishes a marital relationship. What you quoted is only for people on K visas who already submitted a petition proving a familial relationship.
So for the OP AOS is $420 for the I-130 plus $1070 for the I-485. Usually this is done at the same time. Unclear why the OP did it separately.

Inky reacted to Harpa Timsah in Two problems with AP
This is really derailing the thread...
Why on earth would he choose to file a waiver, something that costs more money, and is not guaranteed to be approved?
And beyond that, if she left, she would need a spousal visa to start over.
The OP is stuck and its his fault. His wife should be mad at him for failing to file for her AOS in a timely manner. Actions have consequences.
-
Inky reacted to Harpa Timsah in Two problems with AP
Patently FALSE.
Her out of status was unlawful presence, illegal days, and DO count toward a ban. Shocking, horrible, dangerous advice.
-
Inky reacted to Harpa Timsah in Two problems with AP
Your wife CANNOT travel using AP. By delaying her AOS you have made her subject to a ban when she leaves. You are quibbling about a day or two to try to make that she doesn't have a ban, but by your NOA1 date she has it. You can't speed up the issuance either, but it doesn't matter because if she leaves she CANNOT return.

Inky reacted to Harpa Timsah in do you need a 1040 form?
W2 is NOT a tax return.
You need a complete tax return. That includes 1040, W2s, 1099s, any schedules, etc. You seem misinformed on what a tax return is. You need all of it, not just a part.
It's like someone is telling you you must dress in winter clothes for a snow storm and you are saying, "I have one boot, that's all I need right?"

Inky reacted to slowlyman in PRENUPTIAL AGREEMENT
I've enjoyed following this discussion. It's interesting to see the different points of view people have on this topic.
No one goes through the Visa process or plans a wedding with the idea a divorce is in the future, but divorces happen. No one enters into a marriage with the idea one party is seeking financial gain, but people marry for money all the time.
When a relationship is new and everyone is in love the idea of sharing everything equally and splitting amicably seems very easy and logical. But when things go pear shaped, the love is gone, and bitterness takes it's place, suddenly the idea of sharing and splitting equally gets a bit more complicated.
Having a pre defined set of "rules" helps significantly during an emotional time.
This new person comes into my life, and we split for any reason. Maybe nothing sinister, maybe she just can't adjust to 20 below winters, or I find raising another mans child is more stressful then I expected. It doesn't mean we didn't love each other at the start. We both had the best intentions. Stuff happens.
I've spent the last 30 years building what I have today. Should I now be subject to a judge determining if some of my assets should be shared with her after only a couple years together.?
Yes, it's planning the divorce before the marriage, but I've seen how bitter divorces can get. Sometimes revenge and hurting the other person is a top priority. Talking about these things and finding an agreeable resolution when we like each other seems like just good sense.

Inky reacted to Lynkali in Affidavit of Support (I-134)
It's my understanding based on many posts here, that real estate (a home) cannot count as assets unless it is a SECOND home that you can readily sell for cash. Your own home that you live in cannot be converted to cash without putting you out on the street and/or forcing you to rent, so it does NOT count as an asset for these forms.
I could be wrong, but dozens of posts on the forums here, as well as common sense when considering what is a "liquid asset" (as stated in the form instructions), lead me to think that the house does not count.
