  2. If all is forgiven, which I do not believe, then F3 would be the way to go on the assumption the child is still a dependent. If the IR5 come through then yes the non F3 petitioned spouse could go first of there is such a desperation. Would it be worth it to test the waters, not my call. I suppose the child could be young and F2a is viable but with the other child being in their 20s at least that sounds unlikely? And even the F2a will take a long time. I know I am not so pessimistic but F2a will take quite a few years.
  3. As far as I can tell the OP just wrote a statement listing all their past misdeeds. I have never heard of a Consulate giving absolution and I doubt it is legally possible or that it happened. More something for the Catholic Church. How is the other one going to immigrate to the US?

  10. I had a look at past posts and nothing there to help clear up the matter. I was wondering how the Consulate found out, why you went to the Interview, did the Medical etc. I would not try Reinstatement without a Lawyer.

  12. I always think this sort of case is where a Lawyer has a big advantage, we just know some details and a lot is vague. A Lawyer would get a detailed timeline with supporting documents, for example the admission of guilt.
  13. There is not a set time I have heard of, not sure I remember seeing such a case, more when you get to a point where a Court would consider the time taken unreasonable.

  16. I do not think IR2 applies here, it would be IR5 or F2a.
  17. Certainly read that they were both involved but if only one of them was that would be an option, for the F3 it would depend which one it was. Of course the IR5 for one of them in this theoretically case would be the only alternative. The non involved Spouse moves, files for the other child, we do not know the age, I am assuming that F2b will be more likely. The petition filed by the US born child can have the newly arrived Spouses hardships used but that is obviously going to be more challenging than a conventional situation. Just for the completeness. this is the stated issue: I see at least 2, maybe 3 grounds for a Waiver being required and they have of course got a signed statement admitting it. There was mention of a Lawyer being involved, not clear if that Lawyer has been told the full story.
