  1. Thanks
Matt & Bing got a reaction from Genesisfan in what is I-797 form???
A Form I-797c is a Notice of Action. It is not necessarily a "NOA1". NOA1, NOA2, etc. have no official meaning. Your first notice is usually just the receipt notice for the petition filing fee. Your second notice will be an RFE (request for evidence)or the approval notice. You will receive many more Forms I-797c as you proceed through adjustment of status and removing of conditions.

Wouldn't sending in every page of the passport when they ask for only the page(s) containing the visa be a deviation possibly causing a denial??
Like you say, do what they say (which is not sending in every page).

The "waiver" for permission to apply for more than two K-1 is just a letter that you send with the petition asking for an exception. Getting out of that requirement and doing a CR-1 does not free him of his own history of being a personal immigration portal. The US gov has checks in place to prevent people from becoming personal immigration portals. This visa itself doesn't matter as much as his own past, and either way he will have more to overcome than ever before to prove this is a valid relationship.

You are 100% wrong. A CR-1 is NOT a K-1. The limitation applies to a lifetime limit on K-1 visas. There is no lifetime limit on CR-1 visas.
    Quit giving misleading, incorrect advice.

The notification and greencard are all you need. You will have to surrender your greencard, for once you are sworn in you will not longer be a foreigner.

The only thing that can be done to affect the speed of petition approval is to make sure your petition is well organized and everything required is included. Beyond that, there is nothing you can do.

    Read the instructions better: http://www.uscis.gov/sites/default/files/files/form/n-400instr.pdf
General Eligibility Requirement #3 clearly states that you must have resided in the jurisdiction from which you are applying for 3 months before you are able to submit your N-400.

Before the instructions were updated earlier this year, as you indicated, the warning about needing to reside in the same district for 90 days was included in the naturalisation worksheet, also linked from the N-400 page: http://www.uscis.gov/sites/default/files/files/article/attachments.pdf (eligibility worksheet, question 6). This was most recently updated in 2006, and has been available since then.
I apologise if I seem harsh, it just aggravates me when information is plainly available and people do not avail themselves of it. When it comes time to apply for citizenship for myself, you can be sure I will read every form, every instruction, every page backwards, forwards, and side-to-side. We're human though, so we make mistakes; all we can do is try to minimise them the best we can.

Your case is unfortunate. It happens far more often than you think since this is a country with a very mobile workforce so I sympathise with your case. However:
    1) You must not have looked over the instructions carefully because this requirement is not only mentioned very plainly in black and white, but it is very common knowledge. It must have slipped your attention
    2) The Immigration Officer did you a considerable favour by advising (not forcing, per se) your wife to withdraw her application. Your wife was ineligible at the time unfortunately, and the officer would have been well within her rights to deny the application outright. If that had happened, your wife would have had to declare this denial in all further dealings with the USCIS which would only subject her to additional scrutiny and likely processing delays
    3) The additional $680 fee does not go to the officer, neither is the office compensated for cases that are denied and appealed and invariably generate more revenue for the USCIS. You seem to imply she had financial motives
I wish you better luck in your new application. Make sure there are no seemingly harmless conditions you're not fulfilling, and your wife ought to be alright this time.

That does not matter.US citizens and Legal Permanent Residents are required to file US tax returns on their worldwide income even if nothing is earned in the US and there is no tax liability.
Your husband needs to file a PI tax return if he is required.
He also need to file a US tax return if he earned more than the statutory amount requiring a filing.
He needs to file his US tax return or have a statutory excuse from filing because his income does not meet the filing threshold in order to meet the I-864 requirements.
So, no US tax return or no valid excuse not to file means you cannot get a visa even if you Joint Sponsor who meets all the other requirements.

I don't think its any more an issue to provide tax advice as we already provide immigration advice. Yes there may be risk associated with people accepting and acting upon tax advice, but how is that different from people accepting and acting upon immigration advice that is already given?

US men are marrying foreign women every single day that they met online and visited once. The only requirement for K1 is to have met face to face at least once in the past two years and be free to marry. Your situation is not unique and there is no requirement that you even love each other. No one can tell you how to make the best choice for yourself. If you don't know, then no-one does.

I do not know why once in a while this same question is asked and there are thousands of reply for and against. There are lots reasons for each person to apply. There is no right or wrong answer. It is all upto the individual. There are thousands of questions like this and all ends up with the same answer it is upto each individual
    Other questions like
    1) Why do you have to get married
    2) Why do you want to have kids
etc.... your question also falls in the same category.

    Excellent on the estate tax.
If he was not a US citizen or LPR, then he has no obligation to file US tax returns on his Canadian income.
As a USC or LPR, he would need to report his Canadian income on US tax returns even if no taxes are due.

The US has this covered. There is an exit tax on your worldwide assets that needs to be addresses when you give up your US citizenship.
To be blunt - it would be a hugh loophole (and stupid tax policy) to let people enjoy the benefits of citizenship and then avoid the tax responsibilities by simply giving up citizenship. That's why there is an exit tax.

My current passport is foreign. Foreign passports are not accepted in the US as proof of ID. Besides this, it does not have my name in it. I cant get a State ID becasue I have no US birth certificate and my name is illegal. I have my own printer. So I do not need a post office to take my picture.
No one gave me an answer yet. You are reported troll!
