what is I-797 form???

Hellow again...I received an email/text today from USCIS stating: "that I-129f has been received and routed to vermont service center...within 7-10 days you will receive your official receipt notice form I-797"....does this mean were moving in the right direction? Or nothing at all that I can still get RFE or denied for any reason? Thanks....

I797 is your notice of action, or your NOA1. It means you are moving in the right direction as Vermont has received your petition. On your I797 you will get your case number which can be used to track your case.

Sadly, it doesn't mean that an RFE isn't in your future, we got ours 6 months after our NOA1.

Ignacio, Good Day to you. Your I-797 is your NOA1, your receipt with your case number from USCIS. Once Vermont receives, the average time before your petition is adjudacated, could be from 90-150 days. If you look on this site, there's historical data that shows the time from your NOA1 to your NOA2 is 123 days. After an approval, it is forwarded to NVC where it could be there up to 3 weeks before being sent to the Embassy. Good Luck, and let me know if you need any questions answered.

I just received my NOA2, and it is currently at NVC..Shortly it'll be forwarded to Manila, and than the process goes really fast..GOD BLESS YOU.

The I-797C is a Confirmation from USCIS that you submitted Documents and were Acceptable. (You will also see they Cashed your check) Thus, a NOA1 soon in the mail.

Now the wait period comes into play. USCIS will now conduct background checks and you await your NOA2. As Canadian Wife mentioned a posible Request for Evidence may come later. (RFE)

Generally this only happens in about 25% of Petitions Submitted.

Your on your way. I have seen Couples not even get a NOA1. THIS IS THE START.

After you get your HARD Copy. Which is Just a Piece of Fancy paper from Homeland Security. That is the I-797C (Or a NOA1) It will have a Receipt # and you can track your case.

Keep in mind. This website from USCIS is useful but not 100% reliable. Follow the Link and when you get your receipt # I bet your already there in the System. Make a shortcut on your screen to access this.

A Form I-797c is a Notice of Action. It is not necessarily a "NOA1". NOA1, NOA2, etc. have no official meaning. Your first notice is usually just the receipt notice for the petition filing fee. Your second notice will be an RFE (request for evidence)or the approval notice. You will receive many more Forms I-797c as you proceed through adjustment of status and removing of conditions.

Both, simply because USCIS has received your petition and sent out your I797 - that doesn't mean you won't get an RFE. Further, the consulate may also require more information.

It is really just a receipt of the petition and that it has been sent to a Service Centre (Vermont). It doesn't mean anyone has looked at it yet to see if you have included everything they need. Best of luck with your petition.

Nope, your petition has been received and likely put into a filing cabinet, you still have about 5 months before anyone will take a look at it

They are just telling you that they received your paperwork you sent in and sent it to VSC. You now have to wait to see if your I-129F needs an RFE or if your I-129F was approved(NOA2) which can be some months down the road. Good luck on your journey.
