  2. OK thanks for the info LJ - I have my I-134 completed with backup but once I find a co-sponsor will do the same for them.

    I am in tears but at least my gut told me to inquire so I can be prepared.

    When does the Form 864 come into play?

    The 864 comes into play when you'll file for AOS(adjustment of status. This is an enforceable agreement between whomever signs it and the US government. Please read it carefully. Your SO will notbe able work until he has AOS after marriage.

Please read this form before asking anyone to be a co-sponsor.

  4. Thanks you Life's. so my number is $13,963. My UE does not meet that so I need a co-sponsor. Can anyone provide a link to the paperwork for a Co-sponsor? OK feeling the stress rise - so I need a co-sponsor that makes 125% counting up their number of household plus me and that is willing to sponsor. Correct?

    NOOOOOOO you number is not 13, 000, your number is the 18,920 for 2 people. You MUST include your SO, you will be supporting him until he he obtains a job. That could be for 6 months or 2-3 years later. You yourseld is still un-employed 9 10 months later. You have job history in the US, he will not.

    The second column shows the correct 125%, I bold the numbers. That 11,000 is for military only.

  6. but I can Life'sJ....I provided bank statements showing the deposits every two weeks and we are taking ones that show up thru current date. Plus have a large savings.

    Ok - Life'sJ thanks for clarifying - $125% of the poverty level. Dang that is close - I am just over the requirement by $900. Oy

    Note the Jamaica Embassy is strict on the finance, you either meet it or you must have a co-sponsor. Note I will give you the correct $$$ in a minute. I may have round it off.

  7. You will need a co-sponsor, you can't show a steady income fron last November.

    I am a single household and my unemployment benefits ($19,920/yr) are more than the poverty amount listed in the requirements ($11,170) and I am providing paperwork to show that.

    It at 125% and that $$$ is $19,000 the 11,000 you quote is INCORRECT.

    Thanks for taking the time to sort through this messy topic and post. All of this information is invaluable. The "one year" kept coming up in everything I was reading. I wasn't sure if it was the approved I-130 that would expire or this was in regards to the Visa itself. I was hoping for the best - pee and wait for the re-interview.     Kim, your approved I-130 do not expire, that is why I stated in one year just request another interview date. Those who file for a K1, will have to re-file all over agin, because their I-129 will expire.

  9. Since the petition filed was a130, a year from the denial date you can ask for another interview date, the embassy has asked for interval drug screening test to show evidence that he has not continue to particapte in this illegal activity.

    So, wait a year, pee into a cup for testing every 3 months, hope for a negative result, and be-re-interviewed.

    Hope that it all works ut.

  10. I forgot to add you still have work to do regarding the K1, you will have to official withdraw it if you are going to go the CR1 route. You must wait to hear back from USCIS before you can proceed in a new filing. Search on the words NOIR, or NOID.

  11. In your last post, I presented everyone one of your red flags in a question forum. It's not just about getting married, it's also about correcting these red flags. The drug rehab, follow-up is a MUST. It was noted in his files so don't think it was ignored by the CO.

    Your interview dated for the new petition must be a year after the orginial date of denial. So timinig in filing is very important.

    The first question the CO focused on was you have been to Jamaica 8 times, never once did you bring your children to be formally introduce to their new expected step-father.

  12. I know it's no shortage of hairdressers in the US, or rest of the world.

    I was asking because I think that I've special skills in what I'm doing, I'm quite well known in Europe, and I've heard about other people working in the fashion business, and have got that type of visa.

    I don't think it's hard for me to find a job as a hairdresser in the US, but the employer will probably not hire someone without a working visa, so that's the problem :(

    Then you need to look into working for a fashion company, who has employees that have very sepecialized skills.

  13. Picture are not the final in the dcision making. No, a letter from the JP means absoutely nothing, unless he is appying for something to justify his character.

    Based on your timeline above, you show only one vist for the 2012 year, that's where I would focus my engery.

  14. As far as the denial for the drug part he will have to show a rehab program. This might mean he will need to show drug testing done in interval priods of time.

    In egard to the relationship, that denial was probably based on how he answered any questions that were asked of him.

    You said that you have traveled down 8 times, I am quite sure the questions were asked what did you'll do durning those visits? Such as activities, where did you'll stay, who paid for the activities, who iniative the visits, what did you'll do with family, how often did your boys come down with you.

    They probably asked alot of questions regarding your boys and his interaction with them.

    Pictures were the least of their concerns.

    There was something you said in an earlier post, why should marrying him now show commitment. If you go back thru with the K1, that will make the CO stand on their intial assessment. What's the diffrence between marrying now, and marrying 90 days after arrival in the US.

    The US Embassy in Jamaica will require that your husband shows 3 years of income. What I am confuse about is this; is your husband filing as a LPR or a USC? If a LPR then he will have time to make up the 3 years of income, because a visa will probably not be avavilable for you until 3 years after the petition application has been approved.
