I'm asking for a friend who was selected for DV. He's on an F1 or F2 visa and worked for DoorDash for two months, which is a violation, obviously. He's now applying for I-485 since he's already in the US.
He was told if he leaves the US and goes to Canada or a country in the Caribbean for a few days and then returns to the US, his work violation would be erased. Is there any accuracy to this assumption?

Considering Part 8 Q.16 of the I-485 specifically asks applicants “Have you EVER Worked in the United States Without Authorization” and Q.17 asks “Have you EVER Violated the terms or conditions of your nonimmigrant status?” - is your friend planning on answering “NO” to those questions considering he/she will be swearing and certifying under penalty of perjury to the accuracy and correctness of the information contained on the form? Note, those questions are not asking about violations from most recent admission into the US.

This clearly states the previous violation will not be erased. Yes I agree. The same attorney told him don't mention it. Which is bad advice in my opinion.

but i sent my documents ahead and they were translated in Casablanca (the translator needed to see my ID to verify when i arrived )
u do need an appointment to Casa embassy ahead of the visit
arrange your time wisely to go to the cities needed to Casablanca (embassy and translators), Rabat(Office of foreign minister) and the home town for police and judge interviews
pay close attention to holidays as for Morocco EID is coming up and we have 2 big weekends (embassys are closed for US and Moroc holidays)

The first answer you got covers consummation issue but the above does not. Above is all very good information, but if you do the online/proxy/Utah marriage, you must be together with your spouse AFTER or DURING the ceremony and show evidence of that when filing the initial petition. In short, one visit only BEFORE the marriage, is not enough to start the process. Since you'll be dealing with a Consulate that sees a high level of US Immigration fraud, the strongest evidence you have a bona fide (not just legal for immigration purposes) marriage is the evidence of the time you spend together in person. If your goal is to minimize travel and time together, you need to change that goal.

yes, Utah is accepted
for Morocco meet in person before u marry to prove the relationship , itself , is real
meeting someone in Morocco on a trip is great and needed as the moroccan probably would not get a tourist visa to visit US
and meeting in a 3rd country also good
keep boarding passes of any and all trips to show proof u have met in person
Marriage in Morocco has been done by many of us and it just takes time
complicated? the steps are clearly laid out on the US embassy Casablanca site
just follow them
And yes, it takes a few weeks to go thru the process to marry in Morocco but its time spent together which is very important for the interview
Costs? biggest costs is the translations / $10 a page back when i did it (2010)
You need to know the red flag issues that concern a CO for interview in Casa
1. decision to marry within days of meeting online or in person
2. "Hurry to marry" reguest from the Moroccan or fast engagement before or after meeting
3. limited visits or time spent together / this is a big one
4. big age difference
5. education and work experience of the Moroccan
6. interviewer sometimes can be a Moroccan and they will follow Moroccan culture (which is very different than ours)
7. parents of the moroccan approve of the marriage especially the mother
8. dowry accepted and paid (again a culture issue)
Since Casa embassy is already difficult for getting an approved visa, i have not seen any that have tried the Utah Zoom procedure

1. Yes, USCIS and consulate in Morocco will recognize a Utah online marriage if done properly.
2. Absolutely. USCIS will not recognize a marriage until both spouses are in the same place either during or after the marriage ceremony.
You would have to (1) marry via a Utah online marriage, (2) meet, then (3) start the CR-1 process...in that order.
For the purpose of immigration, a couple must consummate the marriage before USCIS will recognize the marriage. Consummation, per USCIS standards, means being in the same place during or after the ceremony. You cannot file a proper I-130 until the marriage has been consummated.

it will assign a CSB2024xxxxxxx number and forward the case to Casa
embassy now schedule K1 interview in Casa
